Condition A — Show sufficient dedicated right-of-way (RIW) on the plat to provide the public R/W half -width of <br />30 feet along the subject propertyfrontage for a City of Salem Collector street. <br />R/W dedication requirements for subdivisions and partitions are in accordance with Marion County Code (MCC) <br />16.33.260. According to County GIS mapping and tax assessor maps, it appears that there is a 10 -foot deficiency <br />in half -width. The R/W dedication shall be shown on the final plat as a 30 -foot half -width dedicated to the public <br />for road purposes. The nexus for this requirement is to accommodate frontage improvements based upon the <br />proposed addition of traffic to County roads. <br />Condition B — Prior to Tentative Plat approval, improve the Hollywood Drive property frontage to current <br />County and City of Salem standards for an urban Collector street by designing, permitting and constructing a 17 - <br />foot paved half -width (largely present) including southern transition taper, curb/gutter, concrete driveway <br />approach and property line sidewalk, any necessary drainage work, and landscaping. <br />Requirements to construct frontage improvements for subdivisions and partitions are in accordance with Marion <br />County Code (MCC) 16.33.320. Nexus for this condition is the proposed addition of traffic to a road in need of <br />widening and urban improvements. Preliminary review of existing street grade relative to that of private property <br />suggests placement of curb and gutter will concentrate stormwater runoff onto the adjoining property to the south, <br />which sits below road grade. Engineering design will need to take into account capture and conveyance of <br />diverted runoff to an appropriate location to avoid property damage. <br />Marion County Tax Assessor commented that according to ORS 92.095, all delinquent taxes that become a lien <br />during the tax year must be paid before a plat is recorded. <br />School District 24J commented that the property is served by Scott Elementary School, Waldo Middle School, <br />and McKay High School. Sufficient school capacity currently exists to serve the proposed development. <br />Elementary school students in this location are eligible for school transportation services while the Middle and <br />High School students are in the walk zone. <br />City of Salem provided information on what the development requirements would be if the property was located <br />inside city limits. <br />Marion County Fire District No. 1 provided a list of fire code requirements the development will be required to <br />meet. <br />GENERAL COMMENTS: <br />6. Portland General Electric commented on their easement requirements. <br />Northwest Natural Gas included a copy of their Request for Service form that is required to serve the property. <br />ANALYSIS AND CONCLUSIONS: <br />7. Roads, Streets and Easement: Standards for these items are listed in Chapter 16.33.160 through 16.33.340 of the <br />Marion County Code (MCC). Those standards that apply to this request include: <br />16.33.160 ENGINEERING STANDARDS AND REQUIREMENTS. Engineering standards and requirements, <br />including but not limited to streets, drainage, access, easements, and thoroughfare improvements, shall be those <br />currently approved by the Marion County department of public works. <br />As outlined in their comments, Marion County Public Works will review all required street and roadway <br />improvements to assure compliance with the engineering standards. <br />16.33.180 DEEDING OF RIGHT-OF-WAYROADWAY. No person shall dedicate for public use, or deed to <br />Marion County, a parcel of land which is used or proposed to be used as access without first obtaining the <br />approval of the board or its designee and delivering the deed to the board for its endorsement.
