B. Make all necessary arrangements with utility companies and other persons or corporations affected by the <br />installation of such underground lines and facilities in accordance with the rules and regulations of the <br />public utility commissioner of the State of Oregon. <br />9. If the subdivision is located within established street lighting district boundary the subdivider shall submit street <br />lighting plans from the appropriate power company to the Director of Public Works for approval. All provisions <br />for wiring for underground installation shall be completed before the final street improvement is made. <br />10. The zone on the property shall change to RS (Single Family Residential) at the time the plat is recorded. <br />APPEAL PROCEDURE: This decision may be appealed to the Marion County Board of Commissioners by submitting <br />a written appeal explaining wherein the Marion County Planning Commission decision is in error, along with a fee of <br />$500.00. The appeal must be received in the Marion County Clerk's Office by 5:00 p.m. May 2, 2014. Please note <br />the County Clerk's Office is in the process of moving the latter part of April from 1115 Commercial Street NE, <br />Salem to the second floor at the Courthouse Square Building, 555 Court St. NE, Salem. It is advisable to call their <br />office at (503) 588-5225 during this time to ascertain their current location. <br />If an appeal is received it will be reviewed by the Board of Commissioners to determine if it merits further hearing and <br />consideration by the Board. Questions regarding this decision or the appeal procedure should be directed to the Marion <br />County Planning Division, 5155 Silverton Road NE, Salem, (503) 588-5038. <br />FINDINGS AND CONCLUSIONS: The Planning Commission decision is based on the following findings and <br />conclusions. <br />The subject property is located in the Salem Urban Growth Boundary, designated Single Family Residential in the <br />Salem Comprehensive Plan, and zoned UD (Urban Development). <br />2. The property is located on the southwest corner of Hollywood Drive NE and Vicki Way NE. The property is <br />undeveloped. <br />Adjacent properties to the north and east are zoned RS (Single Family Residential) and properties to the south and <br />west are zoned UD. These properties are developed with single family dwellings. Property to northeast is zoned <br />RL (Limited Multi -Family) and is developed with an apartment complex.4. <br />The applicant is proposing to subdivide the property into four lots that each be developed with a single family <br />dwelling. The smallest lot will be 4,794 square feet while the largest lot will be 5,690 square feet. The proposal <br />includes adding a 25 foot wide access and utility easement along the existing easement that contains Vicki Way <br />NE. <br />AGENCY COMMENTS: <br />Marion County Surveyor commented that the subdivision name must be approved per ORS 92.090. In addition, <br />the subdivision must be surveyed and platted per ORS 92.050 and the final plat (along with appropriate fees and <br />additional mylar fee) submitted to their office for their review and approval. Per ORS 92.065 a remaining <br />monumentation bond may be required if some of the plat monuments have not been set and/or the installation of <br />street and utility improvements has not been completed, or other conditions or circumstances cause the delay (or <br />resetting) of monumentation. The final plat must be submitted to their office with a current or updated title report <br />that is no less than 15 days old at the time of approval of the plat. The final plat must be submitted with a plant <br />service report and/or title report to their office. <br />Public Works Land Development and Engineering Permits (LDEP) requested that Conditions A and B be <br />included in the approval of the land use decision. LDEP also commented on requirements that are not part of the <br />land use decision and available for review in the planning file. <br />
