4. The applicant is proposing to subdivide the 3.30 acres into 14 lots, each to be developed with a single family <br />dwelling. As proposed, the smallest lot will be 5,030 square feet while the largest lot. will be 9,005 square feet. <br />Eight of the proposed lots will be served by extending Tierra Drive while the remaining lots will be served by an <br />access off of Hollywood, Drive. There is an existing drainage ditch that the applicant proposes to reroute to <br />accommodate development of the subdivision. <br />AGENCY COMMENTS: <br />Marion County Surveyor commented that the subdivision name must be approved per ORS 92.090. In addition, <br />the subdivision must be surveyed and platted per ORS 92.050 and the final plat (along with appropriate fees and <br />additional mylar fee) submitted to their office for their review and approval. Per ORS 92.065 a remaining <br />monumentation bond may be required if some of the plat monuments have not been set and/or the installation of <br />street and utility improvements has not been completed, or other conditions or circumstances cause the delay (or <br />resetting) of monumentation. The final plat must be submitted to their office with a current or updated title report <br />that is no less than 15 days old at the time of approval of the plat. <br />Public Works Land Development and Engineering Permits (LDEP) requested that Conditions A through H be <br />included in the land use decision, if approved. LDEP also commented on requirements that are not part of the <br />land use decision and available for review in the planning file. <br />"Condition A — Show sufficient dedicated right-of-way (R/W) on the plat to provide the public R/W half -width of <br />30 feet along the subject property Hollywood Drive frontage for a City of Salem Collector street. <br />R/W dedication requirements for subdivisions and partitions are in accordance with Marion County Code (MCC) <br />16.33.260. According to County GIS mapping and tax assessor maps, it appears that there is a 10 -foot deficiency. <br />in half -width. The R/W dedication shall be shown on the final plat as a 30 -foot half -width dedicated to the public <br />for road purposes. The nexus for this requirement is to accommodate future frontage improvements and utilities. <br />It appears an additional 10 feet is needed. <br />Condition B — On the subdivision plat, show dedicated right-of-way (R/69 width of 60 feet for the proposed <br />interior streets, including 30 foot radii at intersections. <br />R/W dedication requirements for subdivisions and partitions are in accordance with Marion County Code (MCC) <br />16.33.260. Nexus is the stipulation for construction of public access improvements in support of the anticipated <br />addition of vehicular and pedestrian traffic. Any dedications should be to the public. <br />Condition C— On the subdivision plat, show any utility easements necessary for placement ofplanned utility <br />vaults outside of the public right-of-ways. <br />Condition D — On the subdivision plat, provide an ESSD drainage easement width equivalent to the design <br />channel width plus 10 feet on either side of each defined top -of -bank, and, a minimum 10 foot wide maintenance . <br />easement from Hollywood Drive. <br />Condition E — Prior to plat approval, design, permit and construct to City of Salem standards, Hollywood Drive <br />urban frontage improvements, said improvements anticipated to consist of 17 feet half -width of roadway <br />pavement including tapers, curb/gutter, sidewalk, street connection, ADA ramps, landscape strips, closed system <br />stormwater drainage collection and conveyance, and signing and striping. <br />Condition F — Prior to plat approval, design, permit and construct to current County and City of Salem <br />standards, 34 foot wide; full -street improvements, said improvements. anticipated to consist of roadway pavement, <br />curb/gutter, sidewalk, driveway drops, ADA ramps, landscape strips, closed system stormwater drainage <br />collection and conveyance, water quality treatment bioswale planter strips or in combination with attenuation <br />feature(s) on private property, and signing and striping. <br />
