Requirements to construct necessary public improvements for subdivisions and partitions are in accordance with <br />MCC 16.33.320. The improvement width and urban features are anticipated to be tapered in order to align with <br />the existing urban section to the north, and rural section to the south. <br />Condition G — Prior to subdivision plat approval, design, permit and construct the ESSD drainage channel <br />realignment that is necessitated by the proposed subdivision layout. <br />The East Salem Service District `B' -Line, open drainage channel, traverses the subject property within a 28 -foot <br />wide easement, said easement recorded at Reel 3 01 5, Page 346, in the Marion County Clerk of Court records. <br />Applicant is responsible to obtain any and all permits from DSL/ALOE and the County for realignment. Ditch <br />relocation is subject to the County's construction bonding requirements. Included in the design shall be a <br />graveled driveway located within a maintenance easement leading from Hollywood Drive to the ditch. <br />Condition H— Prior to subdivision plat approval, construct stormwater detention and water quality facilities. <br />Completion of the stormwater attenuation requirement is being elevated to Condition status relevant to its timing <br />for completion. Nexus is meeting MCPW Engineering Design Standards for development. Details are provided <br />under Engineering Requirements. <br />City of Salem commented that the proposed waterway improvements do not appear to meet the City Public <br />Works Design Standards. They propose the following conditions be met prior to plat approval: <br />Pursuant to Council Policy S-1 (Jan Ree Water) and the intergovernmental agreement between the City <br />and the East Salem Service District (Sewer), the applicant shall obtain permits from the City of Salem for <br />construction of water and sewer mains to serve the proposed lots. <br />2. The applicant shall be required to file an application for annexation pursuant to SRC 72.220 and SRC <br />73.030. " <br />Marion County Building Inspection Division commented that building permits may be required. If a new <br />dwelling is constructed and the local fire official determines that there is inadequate access or water supply, then <br />one or more of the uniform alternative construction standards in Oregon Administrative Rule 918-480-0125 must <br />be met as determined by the building official. <br />Marion County Fire District No.1 provided a list of fire code requirements the development will be required to <br />meet. <br />ANALYSIS AND CONCLUSIONS: <br />6. Roads, Streets and Easement: Standards for this section are listed in Chapter 16.33.160 through 16.33.340 of <br />the Marion County Code (MCC) and include: <br />16.33.160 ENGINEERING STANDARDS AND REQUIREMENTS. Engineering standards and requirements, <br />including but not limited to streets, drainage, access, easements, and thoroughfare improvements, shall be those <br />currently approved by the Marion County department ofpublic works. <br />As outlined in their comments, Marion County Public. Works will require all improvements to meet their adopted <br />engineering standards. <br />16.33.180 DEEDING OF RIGHT OF-WAYROADWAY. No person shall dedicate for public use, or deed to <br />Marion County, a parcel of land which is used or proposed to be used as access without first obtaining the <br />approval of the board or its designee and delivering the deed to the board for its endorsement. No dedication is <br />effective unless the property is accepted by the Board or its designee and recorded with the Marion County <br />clerk's office. <br />Required right-of-way dedications will be accomplished through the platting process which requires acceptance <br />by the Marion County Board of Commissioners. <br />
