Building permits are required." <br />The County Assessor noted that the acreage is currently <br />being specially assessed as forest land. <br />2.Section 119.070 of the Marion County Rural Zoning Ordinance <br />(MCRZO) provides the following criteria for review of a <br />conditional use request of this nature: <br />(a)That the Hearings Officer has the power to grant the <br />conditional use; <br />(b)That such conditional use, as described by the appli- <br />cant, shall be in harmony with the purpose and intent <br />of the zone; <br />(c)That any condition imposed is necessary for the public <br />health, safety or welfare, or to protect the health or <br />safety of persons working or residing in the area, or <br />the protection of property. <br />3.Section 119.030 grants the Marion County Hearings Officer <br />the authority to approve those conditional uses listed in <br />the Ordinance. Section 128.030(k) includes "churches, <br />public and private schools and related conference and resi- <br />dence facilities" as a conditional use within the AR zone. <br />However, Planning Division staff is uncertain that the <br />proposal falls under the parameters of this ordinance pro- <br />vision. Based on the wording of this section, churches and <br />public or private schools may be conditionally allowed <br />within the zone, but any conference and residence facilities <br />must be secondary or accessory to a church or school. In <br />the applicant's proposal, it appears that primary use of the <br />property will be conference and/or residence facilities, <br />with church or instructional activities being secondary. <br />4.As previously noted, the 16' foot strip providing access to <br />the conference facility is located within a UT-5 zone. <br />Since this area is part of the proposed development, it must <br />be consistent with the requirements of the UT-5 zone. <br />5.Section 128.010 of the AR zone states that "the purpose and <br />intent of the Acreage Residential zone is to provide appro- <br />priate regulations governing the division and development of <br />lands designated Rural Residential in the Marion County <br />Comprehensive Plan. Acreage Residential zones are areas <br />that are suitable for development of acreage homesites. <br />Such areas are necessary to met the housing needs of a <br />segment of the population desiring the advantages of a rural <br />homesite.
