SALEM COURTHOUSE SQUAR NC. <br />Abatement <br />SECTION 00900 <br />GENERAL CONDPI'IONS <br />1997 PAGE 1 OF 6 <br />GENERAL CONDITIONS <br />901 PAYM~NTS BY THE CONTRACTOR: Under the ~rovision of ORS 279312, the contractor shall: <br />a.)Make payment promptly, as due, to all persons supplying to such CONTRACTOR labor or material <br />for the prosection of the work provided for in such contract. <br />b) Pay all coutributions or amounts due to the Workers' Compensation Insurer from such <br />CONTRACTOR or subcontractor incurred in the performance of the contract. <br />c) Not permit any lien or claim to be filed or prosecuted against the owner on account of any labor or <br />material furnished. <br />d) Pay to the Revenue Department all sums withheld from the employee pursuant to ORS 316.167. <br />e) Under the provisions or ORS 279314 and OAR 839-16-020, if the CONTRACTOR fails, neglects or <br />refuses to make prompt payment of any claim for laborer seivices furnished to CONTRACTOR, or a <br />subcontractor, in connection with work to be done under this contract as such claim becomes due, <br />OWNER may pay such claim to the person furnishing the labor or services and charge the amount of the <br />payment against funds due or to become due CONTRACTOR by reason of this contract The payment <br />of a claim in the manner authorized in this section shall not relieve the CONTRACTOR, subcontractor <br />or any surety from their obligation with respect to any unpaid claim. <br />902 WORKING HOURS: Under the provisions of ORS 279.316, no person shall be employed for more <br />than eight (8) hours in any one (1) day, or forty (40) hours in any one (1) week, except in cases of <br />necessity, emergency, or where the public policy absolutely requires it, and in such cases, the laborer <br />shall be paid at least time and a half for a11 overtime in excess of eight (8) hours and for work performed <br />on Saturday and on any legal holiday specified in ORS 279.1334. <br />903 ENVIRONMENTAL PROTECTION: Under the provisions of ORS 279318, if this contract is for a <br />public improvement as defined by ORS 279.Oll (6), the CONTRACTOR must comply with all Federal, <br />state and local statutes, ordinances and regulations dealing witht he prevention of environmental <br />pollution and preservation of natural resources that affect the project. These include the requirements of <br />Environmental Protection Agency (Region 10), U.S. Army Corps of Engineers, and the Oregon <br />Department of Environmental Quality. <br />If CONTRACTOR is delayed or must undertake additional work by reason of existing regulations or <br />ordinance of agencies dealing witht the prevention of environmental pollution and the preservation of <br />natural resources that affect the performance of this contract and that have not been cited in this contract, <br />or are due to the enactment o fnew or the amendment of exisiting statues, ordinances or regulation <br />srelating to the prevention of environmental pollution and the preservation of natural resources occurring <br />after the submission of the successful proposal OWNER shall grant a time extension and issue a change <br />order setting forth the additional work that must be undertaken. The change order shall not invalidate <br />the contract and there sl~all be a reasonable extension of the con[ract time. <br />904 MEDICAL PAYM~NTS: As provided by ORS 279320, CONTRACTOR shall promptly, as due, <br />make payment to any person, co-parmership, association or corporation, furnishing medical, surgical and <br />hospital care or other needed care and attention incident to sickness or injury to [he employees of such <br />
