SALEM COURTHOUSE SQUARI .VC. <br />Abatement <br />1997 <br />SECTION 00900 <br />GENERAL CONDPI'IONS <br />PAGE 2 OF 6 <br />CONTRACTOR, of all sums which the CONTRACTOR agrees to pay for such services and all monies <br />and sums which the CONTRACTOR collected or deducted from the wages of his employees pursuant to <br />any law, contract or agreement for the purpose of providing or paying for such service. <br />905 AGR~~M~NT TO TERMINAT~: <br />1. As provided by ORS 279325, OWNER and CONTRACTOR may agree to terminate the contract: <br />a) if work under the contract is suspended by an order of a public agency for any reasons <br />considered to be in the public interest other than by a labor dispute (as defined in ORS 602.010) <br />or by reason of any third party judicial proceeding relating to the wark other than a suit or action <br />filed in regard to a labor dispute; and <br />b) if the circumstances or conditions are such that it would be impractical within a reasonable <br />time to proceed with a substantial portion of the work. <br />2. As provided by ORS 279.329, if work under this contract is suspended pursuant to subsection (1)(a) <br />of this section, and is not the result of a labor dispute but the con[ract is not terminated, CONTRACTOR <br />is entitled to a reasonable extension of the contract time and reasonable compensation for all costs <br />resulting from the suspension plus a reasonable allowance for overhead with respect to such costs. <br />3. As provided by ORS 279330, in the event of termination of this contract pursuant to this Section, <br />CONTRACTOR shall be paid a reasonable amount of compensation for preparatory wa~k and all costs <br />and expenses arising out of termination. The amounts to be paid to the CONTRACTOR: <br />a) shall be determined on the basis of the contract price in the case of any fully completed <br />separate line or portion of the work for which there is a separate or unity contract price; and <br />b) may, with respect to any other work, be a percentage of the contract price equal to the <br />percentage of the work completed. <br />4. As provided by ORS 279.333, this Section shall not apply to suspension of the work or termination of <br />the contract which occurs as a result of CONTRACTOR'S violation of Federal, State or local statutes, <br />ordinances, rules or regulations in existence at the time the contract was executed or as the result of <br />violations of the terms of the contract. <br />906 PREVAILING WAGE: As provided by ORS 279348 ro 279353, if this contract is for a"public <br />works" as defined by ORS 279348(3) CONTRACTOR sl~all pay prevailing wages and comply widi all <br />state and federal laws iu the employment and payment of labor. Current prevailing wage rates are shown <br />in Appendix "A", "Prevailing Wage Rates for Public Works Contracts in Oregon" dated January 1, <br />1997. Prevailing Wage Rates shall be posted in a conspicuous place at the work site throughout the <br />duration of the work. The Contractor shall submit copies of Certified Payroll information to the Bureau <br />of Labor and Industries Wage and Hour Division and the Owner as described in Appendix A:~Each <br />request for payment submitted under this contract shall include Certified Payroll Statements through the <br />end of period for which payment is sought. <br />
