PAGE 1 OF 2 The CONTRACI'OR shall be responsible for filing and bearing the cost of the Department of Environmental Quality Asbestos Abatement Notifications for all portions of the work. 802. ENVIRONMENTALPROTECI'ION: Under the provisions of ORS 279.318, if tlus contract is for a public improvement as defined by ORS 279.011(6), the CON'CRACTOR must comp(y with all Federal, State, and local statutes, ordinances and regulations dealing witli the prevention of environmental pollution and preservation of natural resources that affect the pmject. These include the requiremeots of Envimnmental Protection Agency (Region 10), U.S. Army Corps of Engineers, and the Oregon Department of Environmental Quality. If CONTRACI'OR is delayed or must undertake additional work by reason of existing regulations or ordinances of agencies dealing with the prevention of environmental pollu6on and the preservation of natwal resources that affect the performance of tlus wntract and that have not been cited i n this contract, or aze due to the enactment of new or the amendment of eausting statutes, ordinances or regulations relating to the preven6on of environmental pollu6on and the preservation of natural resources occurring after the submission of the successful bid OWNER shall grant a time extension and issue a change order setting forth the additional work that must be undertaken. The change order shall not invalidate the wntract and there shall be a reasonable extension of the contract time. 803. PATENTS: As a condition to entering into the contract agreement, the Contractor assumes full responsibility for any applicable licensing agreement that may be required to accomplish the work set forth within the technical specifications when aqy device or process specified herein or required by the work is sub~ject to the United States Patent orTrademark. The prceess and devices specified witlun the technical speciftcations are not intended to grant any rights [o the Contractor. The Contractor agrees upon entering the contract to obtain any required licensing agreements enforceable under the United States Patents or Trademark, and further the Contractor, and his surety, agree to hold the Owner and Technical Consultant hamiless for damages for Patent or Trademark infringement including cost for attomeys fees of said Owner or Technical Consultant. 80 4. CONTRACI'OR REGISTRATION AND LICENSING: The Contractor shall provide written evidence to the Owner proving that contractor is a registered or licensed as required by law of Oregon State, ORS 468.883.
