Page 2 The contractor shall be made immediately aware of any "right to lien" notices that may be received by the owner during ~he cour~e of the pro~ect so that appropriate care can be taken to insure all billings are properly handled. The purchasor warrants that he/she has good and marketable title to subjeat property (or a tenant lease) and that he/she has knowledge of the true and actual boundary lines. and that if future discrepancies do arise that the contractor shall be held harmless. Any survey costs necessary to establish property lines or markers shall be paid by the owner/purchasor unless otherwise provided for by this agreement. The contractor shall execute the projeCt in as reasonable time as possible~ and in a good and workmanlike manner in keeping with standard construction practices. and in conformance with all applicable provisions of local building codes and ordinances. The project will begin as soon as possible after Feb. 3, 1997 and shall be completed in approximately 8 weeks. notwithstanding circumstances ~hat are not of the contractor's control. The liability of the contractor for defective materials or installation i~ hereby agreed to be limited to only the replacement or correction of the defective material and installation thereof. and no other claims shall be made upon the contractor. Assemblies or units purchased by the contractor and included under this contract are subject only to the manufacturer's quarantee. not the contractor's. This is therefore understood to be a limited warranty. There are no warranties which are extended or implied beyond this description. The contractor shall arrange for and be financially responsible under this agreement for all materials and workers required to complete the project except for items specifically excluded. The contractor' shall store and be responsible for all tools and materials used on the project. All debris and unused material. tools~ and equipment will be removed from the site in a timely manner. Al1 unused materials remain the property of the contractor. All sub-contractors shall maintain such insurance as will protect the contractor and purchaser from claims of injury under worker compensation and from all other claims which may arise from operations under the responsibility~ control. and/or supervision of the contractor. Loss due to fire or other comprehensive damages must be covered by tt~e purchasor.
