Page 2 <br />The contractor shall be made immediately aware of any "right to <br />lien" notices that may be received by the owner during ~he cour~e <br />of the pro~ect so that appropriate care can be taken to insure all <br />billings are properly handled. <br />The purchasor warrants that he/she has good and marketable title to <br />subjeat property (or a tenant lease) and that he/she has knowledge <br />of the true and actual boundary lines. and that if future <br />discrepancies do arise that the contractor shall be held harmless. <br />Any survey costs necessary to establish property lines or markers <br />shall be paid by the owner/purchasor unless otherwise provided for <br />by this agreement. <br />The contractor shall execute the projeCt in as reasonable time as <br />possible~ and in a good and workmanlike manner in keeping with <br />standard construction practices. and in conformance with all <br />applicable provisions of local building codes and ordinances. <br />The project will begin as soon as possible after Feb. 3, 1997 and <br />shall be completed in approximately 8 weeks. notwithstanding <br />circumstances ~hat are not of the contractor's control. <br />The liability of the contractor for defective materials or <br />installation i~ hereby agreed to be limited to only the replacement <br />or correction of the defective material and installation thereof. <br />and no other claims shall be made upon the contractor. Assemblies <br />or units purchased by the contractor and included under this <br />contract are subject only to the manufacturer's quarantee. not the <br />contractor's. This is therefore understood to be a limited <br />warranty. There are no warranties which are extended or implied <br />beyond this description. <br />The contractor shall arrange for and be financially responsible <br />under this agreement for all materials and workers required to <br />complete the project except for items specifically excluded. <br />The contractor' shall store and be responsible for all tools and <br />materials used on the project. All debris and unused material. <br />tools~ and equipment will be removed from the site in a timely <br />manner. Al1 unused materials remain the property of the <br />contractor. <br />All sub-contractors shall maintain such insurance as will protect <br />the contractor and purchaser from claims of injury under worker <br />compensation and from all other claims which may arise from <br />operations under the responsibility~ control. and/or supervision of <br />the contractor. Loss due to fire or other comprehensive damages <br />must be covered by tt~e purchasor. <br />
