( -4 ~~~ ~ <br />_ _ _~n ~ <br />-- ----- - - <br />__ _ - -- - - __ _ _-- <br />NSTRUCTION <br />16000 SW MIDWAY ROAD <br />HILLSBORO, OREGON 97'i23 <br />CONTRACT FOR CONSTRUCTION <br />This agreement is entered into between S&S Construction. general <br />contractor, and Mar-Po F.C.U. to remodel their leased space at 205 <br />Chemeketa, Salem. Or. <br />The essence of this agreement shall be the contractor's proposal <br />dated Jan. 27. 1997 her~inafter refexred to as Addendum "A"~ <br />together with plans and specifications as designed by Tom Johnson <br />of Financial Facilities Design ~nd Construction. dated Jan. 13.16, <br />1997. Any plan changes made after Jan 27, 1997 must be evalu- <br />ated as to cost. <br />Should any governing agency demand chattges in the structure or site <br />affecting changes in grading. storm drains, asphalt. concrete work, <br />handicap access. wall changes, special permitting~ or any other <br />changes significant to the plan not otherwise intended. or should <br />actual site or building conditions prove to be different than those <br />represented by the drawings~ either by error of ommission or scale. <br />the contractor shall not be held financially responsible. ~Such <br />changes shall result in reasonable adjustments. consistent with the <br />spirit of this agreement. <br />Further, the contractor or his subcontractors shall not be held <br />responsible for sub-surface or unforseen conditions existing on- <br />site such as (but not lim~.ted to) large baulders, springs, <br />landfills. storage tanks. toxic waste material. etc. Any asbestos <br />material. if existing~ must be handled in a special manner. and in <br />accordance with legal asbestos abatement procedure and must be <br />treated as an extra cost. <br />If a special asbestos abatement contractor must be hired for any <br />reason~ that contract will be directly with the purchasor and the <br />abatement contractor will answer directly to the purchasor for his <br />portion of an~ work performed. <br />The contractor shall not be held liable for any conditions that <br />exist that are not apparent on inspection or that the contractor <br />has not in some way been informed of. regarding either the site or <br />the building. <br />No allowance is made tor site work regarding parking, paving~ etc. <br />or any work to exterior of building. <br />
