11 <br /> 12 <br /> <br /> 14 <br /> 15 <br /> 16 <br /> 17 <br /> 18 <br /> 19 <br /> 2O <br /> <br /> 21 <br />=~ 22 <br /> <br /> 24 <br /> 25 <br /> <br /> 26 <br /> Page <br /> <br /> 1 <br /> 2 <br /> 3 <br /> 4 <br /> 5 <br /> 6 <br /> 7 <br /> <br /> 7. <br /> 9 <br /> <br />10 <br /> <br /> Co <br /> <br /> 1. <br /> <br /> 2. <br /> <br />Are reasonably related to development allowed in the <br />proposed zone or the specific development proposed on <br />the subject property. <br /> <br />Will serve a public purpose such as mitigating the <br />negative impacts of allowed uses on adjacent proper- <br />ties. <br /> <br />Are based upon policies or standards in the Comprehen- <br />sive Plan or other standards adopted by the Board of <br />Commissioners or by state and federal agencies. <br /> <br />The requested zone change from EFU to ID would allow a more <br />intensive use of the subject property. <br /> <br />The conditions set forth in Section C 5 infra are related <br />to the proposed use of the subject property, will serve a <br />public purpose and are based upon the policies of the <br />Marion County Comprehensive Plan. <br /> <br />CONDITIONAL USE <br /> <br />The request for a conditional use is only relevant if the <br />comprehensive plan amendment and zone change are granted. <br /> <br />The relevant criteria to this conditional use are found in <br />MCZO 119.070 as follows: <br /> <br />(a) That the Hearings officer has the power to grant the <br /> conditional use; <br /> <br />(b) <br /> <br />That such conditional use, as described by the <br />applicant, will be in harmony with the purpose and <br />intent of the zone; <br /> <br />(c) <br /> <br />That any condition imposed is necessary for the public <br />health, safety or welfare, or to protect the health <br />or safety of persons working or residing in the area, <br />or the protection of property or improvements in the <br />neighborhood. <br /> <br />The Hearings Officer can only make a recommendation on this <br />conditional use application because the zone change and <br />comprehensive plan amendment require approval by the Board <br />of Commissioners. <br /> <br />If the comprehensive plan amendment and zone change were <br />to be approved, the proposed use would be in harmony with <br />the purpose and intent of the ID zone, which is to provide <br /> <br />ZC/CP/CU 39-4/RECOM~ENDATION - 6 <br />(ISBERG) <br /> <br /> <br />
