Adherence to this section shall be a condition of approval. <br /> <br />(H) There shall be no outside storage or display of materials, equipment, or merchandise used in or produced <br />in connection with the home occupation. <br /> <br />The applicant’s proposed commercial business is a barber shop that does not involve retail or any kind of large <br />scale equipment. Rather, it provides a service to customers that arrive at the property. It is unlikely that any kind <br />of outside storage of materials, equipment or merchandise would occur, but it shall still be made a condition of <br />approval that the home occupation continuously operate in compliance with this section. <br /> <br />(I) Retail and wholesale sales that do not involve customers coming to the property, such as Internet, <br />telephone or mail order off-site sales, and incidental sales related to the home occupation services being <br />provided are allowed. No other sales are permitted as, or in conjunction with, a home occupation. <br /> <br />The proposed home occupation is a barber business that provides haircutting and styling services to customers on <br />the property. To be compliant with this section, it shall be conditioned that customer visits to the property shall be <br />limited to an appointment only basis and that the property shall not be open to the public. With such a condition in <br />place, the proposal meets the requirements of this section. Therefore, the criterion is met. <br /> <br />(J) The dwelling or other buildings shall not be used for assembly or dispatch of employees to other <br />locations. <br /> <br />The proposed home occupation does not involve the dispatching of employees to other properties, but rather <br />involves customers coming to the subject property. Therefore, the criterion is met. <br /> <br />7. All conditional uses are subject to the general criteria in MCC 16.40.020, these include: <br /> <br />(a) The use is listed as a conditional use in the zone, or is otherwise identified as a conditional use and is <br />consistent with the intent and purpose of the zone and the provisions that authorized consideration as a <br />conditional use. <br /> <br />A home occupation is listed under MCC 16.02.020 (J) and is a use that is consistent with the intent and purpose of <br />the zone, as home occupations are subservient to the use of the property as a residence. The criterion is met. <br /> <br />(b) The parcel is suitable for the proposed use considering such factors as size, shape, location, topography, <br />soils, slope stability, drainage and natural features. <br /> <br />The parcel is located within a developed neighborhood inside the urban growth boundary of Salem. The <br />surrounding land is flat and developed with paved roads that have sidewalk frontage. While the subject property is <br />located on a dead end road, the home occupation is limited to appointment only customer visits to meet the <br />requirements of criterion I in Finding #6 above. This limitation will reduce the traffic going to the business, <br />meaning the dead-end road will not be a significant issue. As far as other characteristics, the property is already <br />developed with electricity, water, and has a driveway capable of parking 3 cars. Overall, the parcel is suitable for <br />the proposed use as it has the required available services and is limited enough in size for the existing road <br />infrastructure. Therefore, the criterion is met. <br /> <br />(c) The proposed use, as conditioned, will not substantially limit, impair, or preclude the use of surrounding <br />properties for the uses permitted in the applicable zone. <br /> <br />The proposed use of a barber business as a home occupation is required to operate such that it meets the specific <br />criteria outlined under MCC 16.32.400, which are the criteria addressed under Finding #6 above. These criteria <br />provide enforceable restrictions on the operation of the business, including limiting customer visits, local traffic <br />impacts, and operating in a way such that it does not cause a nuisance. A condition of any approval of this <br />proposal will be that the barber business continuously operate in compliance with all criteria listed under MCC <br />16.32.400. As long as the business operates in compliance with these restrictions it will not substantially limit, <br />impair, or preclude permitted uses on neighboring properties. Therefore, the criterion is met.
