(B) The home occupation shall be continuously conducted in such a manner as not to create any nuisance, <br />public or private, known law or equity, including but not limited to: noise, odors, vibration, fumes, smoke, <br />fire hazard, or electronic, electrical, or electromagnetic interference. <br /> <br />The applicant proposes to operate a barber business as a home occupation. The business is proposed to be <br />conducted entirely within the dwelling on the property. A barber business can be reasonably anticipated to <br />generate very little noise, odors, vibrations, fumes, or smoke. It is also very unlikely to cause an excess fire <br />hazard, electronic, electrical, or electromagnetic interference in the area. If conducted inside, and limited to <br />appointment only patronage, the business can be reasonably assumed to be able to operate in compliance with this <br />section. The criterion is met and it shall be made a condition of approval that the applicant continuously operate in <br />compliance with this section. <br /> <br />(C) No sign shall be displayed on the premises except those as permitted in MCC 16.31.060(A). <br /> <br />The applicant has not indicated that they propose to erect a sign for the business. However, it shall be made a <br />condition of approval that any sign be in compliance with the regulations cited in this section. The criterion is <br />met. <br /> <br />(D) No structural alterations shall be made to the dwelling that would be inconsistent with future use of the <br />building as a dwelling. <br /> <br />The applicant is proposing to wall off a section of the existing garage to create a new room in which the barber <br />business will operate. It is not unusual for people to erect a partition wall to create additional rooms in existing <br />garages, and the garage can still be utilized for storage and cars parked on the parking slab on the property. <br />Finally, the wall could be removed in the future should new property owners want to fully realize the storage <br />space in the garage again, as the walls will likely not be load bearing. Therefore, the proposed alterations to the <br />dwelling are consistent with development in existing homes and would not be inconsistent with future use of the <br />building as a dwelling. The criterion is met. <br /> <br />(E) No alteration to or use of the premises shall be made that would reduce the number of on-site parking <br />spaces required for dwellings as outlined in MCC 16.30.170. <br /> <br />The applicants are located within a transit corridor overlay area meaning the standards for the number of on-site <br />parking spaces required for a dwelling in this zone is not applicable or enforceable. Additionally, if the standards <br />did apply, the minimum amount of parking spaces for the dwelling would be 2 total spaces, and the existing <br />driveway exceeds the minimum driveway width (16 feet) required for 2 parking spaces, so the garage being <br />potentially unavailable for parking would not reduce the number of required parking spaces below the standard <br />outlined in MCC 16.30.170. The criterion is met. <br /> <br />(F) Parking of customers’ or clients’ vehicles shall create no hazard or unusual congestion. If the home <br />occupation requires any parking for an employee or customer, a site plan meeting the requirements for <br />off-street parking in Chapter 16.30 MCC shall be submitted and approved by the planning manager. <br /> <br />Home occupations that provide services to customers are limited to only allowing customers to visit the property <br />by appointment only. This restriction reduces the potential for a business to over-crowd the existing parking <br />infrastructure such that it becomes a hazard or creates unusual congestion in the local area, because it means that <br />customers only come to the property when there is an availability to help them. That means less people waiting <br />and generating excessive parking congestion. This is important for this location, as it is near the end of a dead-end <br />street. The applicant’s property is developed with an extra wide driveway (about 27 feet wide) and appears to be <br />capable of parking 3 cars at a time. The driveway is sufficient to meet the requirements of this section. The <br />criterion is met, however it shall be made a condition of approval that the home occupation continuously operate <br />in a manner compliant with this section. <br /> <br />(G) Delivery and pick-up of materials or commodities in conjunction with the home occupation to and from <br />the premises shall be made by private vehicles or by commercial vehicles not exceeding two axles in size. <br />
