8. The applicants should contact the Marion County No. 1 Fire District to obtain a copy of the District’s <br />Recommended Building Access and Premise Identification regulations and the Marion County Fire Code <br />Applications Guide. Fire District access standards may be more restrictive than County standards. <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provides that certain applications be considered first by the <br />County Zoning Administrator. If there is any doubt that the application conforms with adopted land use policies and <br />regulations the Zoning Administrator must condition or deny the application. Anyone who disagrees with the decision <br />may request that the application be considered by a county hearings officer after a public hearing. The applicant may also <br />request reconsideration (one time only and a fee of $200) on the basis of new information subject to signing an extension <br />of the 120-day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Planning Division, 5155 Silverton Rd. NE, Salem, by 5:00 p.m. on April 30th, 2026. If you have questions about this <br />decision, contact the Planning Division at (503) 588-5038 or at the office. This decision is effective May 1st, 2026, unless <br />further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />l. The property is designated single-family residential in the Salem Area Comprehensive Plan. The purpose of this <br />designation and the corresponding RS (Single-Family Residential) zone is to provide areas for low density urban <br />residential development. This zone also allows a limited amount of commercial uses as home occupations as long <br />as the commercial use is subordinate to residential uses. <br /> <br />2. The property is located at 3088 Woodleaf St NE, on the east side of the road 150 feet south of the intersection <br />between Woodleaf St and Val Vista Ave SE. The property is developed with a 1983 single-family dwelling and is <br />the second to last house on a dead-end road. The parcel was created as Lot 5 of Block 3 of the Val Vista Estates <br />subdivision and is considered legal for land use purposes. <br /> <br />3. Surrounding uses in all directions are residential in nature, mostly consisting of single-family residences. The <br />Surfwood Villa community is adjacent to the east and the closest non-residential use is an RV park 450 feet north <br />along Woodleaf St. <br /> <br />4. The applicant proposes to operate a barber business as a home occupation on the property located at 3088 <br />Woodleaf St NE. <br /> <br />5. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br /> Marion County Building commented: “Permit(s) are required to be obtained for the construction of interior walls <br />within the garage to create the business use space, similar to the plan submitted with this conditional use <br />application. However, additional information will be needed upon these plans to identify exiting and the location <br />of a restroom for visitors of this business. Discussion with a building plans examiner is recommended prior to <br />submitting application for this permit.” <br /> <br /> Marion County Code Enforcement provided comments regarding previous complaints in the area. <br /> <br />All other contacted agencies either failed to comment or stated no objection to the proposal. <br /> <br />6. Home occupations requiring a conditional use permit in the RS zone must meet the specific criteria in MCC <br />16.32.400. These include: <br /> <br />(A) The premises upon which the home occupation is conducted shall be the residence of the person <br />conducting the home occupation. <br /> <br />The dwelling is owned by the mother of the applicant for this proposed home occupation. The applicant <br />themselves lives in the dwelling. The criterion is met.
