City of Salem Parks Planning commented: <br /> <br />The subject properties abut the McKay Park, owned by the City of Salem, along the eastern property boundary. <br />The site currently has barbed wire topped fencing, along the shared line with McKay Park. It is recommended that <br />the approval be conditioned to prohibit fencing materials that can cause bodily harm along the shared property <br />line. Barbed wire is unsafe, unwelcoming, and inconsistent with the character of both the park and surrounding <br />residential neighborhood. <br /> <br />Marion County Building Department commented: <br /> <br />“Permit(s) are required to be obtained prior to the development of structures and/or utilities installation on private <br />property. The structure containing the water treatment facilities would be reviewed to the 2022 Oregon Structural <br />Specialty Code, and it may be determined the structural design be based on a Risk Category III importance factor.” <br /> <br />Marion County Fire Department No. 1 commented: <br /> <br />1. Fire Safety During Construction: Approved fire department access road, required water supply, fire hydrants, <br />and safety precautions shall be installed and serviceable prior to and during the time of construction. 2022 <br />Oregon Fire Code Chapter 33. <br />2. Premise identification: Buildings shall have address numbers or approved identification placed in a position <br />that is plainly legible and visible from the access road fronting the property. Numbers shall contrast with their <br />background and shall be a minimum of 4 inches height with a minimum stroke width of ½ inch. (2022 OFC <br />505.1) <br />3. Fire Extinguishers: Provide 2-A:10-B:C fire extinguishers inside the building maximum travel distance 75 feet. <br />Fire extinguishers shall be mounted in an approved location with top of extinguisher no higher than 5’ feet. <br />2022 Oregon Fire Code Section 906. <br />4. Hazard Identification Signs: Place NFPA 704 placards on the exterior wall of the building consistent with <br />Sodium Hypochlorite: Health=3, Flammability=0, Reactivity=1. (2022 OFC 5003.5) <br /> <br />6. All conditional uses are subject to the general criteria in MCC 16.40.020, these include: <br /> <br />(a) The use is listed as a conditional use in the zone, or is otherwise identified as a conditional use and is <br />consistent with the intent and purpose of the zone and the provisions that authorized consideration as a <br />conditional use. <br /> <br />Public utilities are listed as a conditional use in the RS zone. The criterion is met. <br /> <br />(b) The parcel is suitable for the proposed use considering such factors as size, shape, location, topography, <br />soils, slope stability, drainage and natural features. <br /> <br />The parcel is 0.16 acres and does not contain steep slopes, unstable soils or drainage issues as it is in a <br />developed subdivision. The water treatment system is already existing, indicating no issues with the <br />properties natural features. The criterion is met. <br /> <br />(c) The proposed use, as conditioned, will not substantially limit, impair, or preclude the use of surrounding <br />properties for the uses permitted in the applicable zone. <br /> <br />The subject water treatment facility will not cause an increase in traffic, as the facility will not require <br />regular attendance and are only subject to sparce maintenance checks. This facility has existed for years <br />and has not caused any known disturbances in the neighborhood. While the construction of the new building <br />may cause additional noise, it is the same as residential improvements in the neighborhood. The criterion <br />is met. <br /> <br />(d) The proposed use, as conditioned, will not have a significant adverse effect on air or water quality. <br />
