The mobile home shall be placed within 100 feet of the north <br />property line. <br /> <br />The concrete fish ponds shall be located within I00 feet of <br />the north property line or the applicants shall submit a <br />certificate from a registered professional engineer certify- <br />ing that the concrete ponds have structural components <br />capable of resisting hydrodynamic loads and effects of <br />buoyancy, and that the ponds are anchored to prevent <br />floatatlon, collapse or lateral movement of the structure. <br /> <br /> PROCEDURE: The Marion County Zoning Ordinance provides that <br /> certain Conditional Use applications be considered first by the <br /> County Planning D/rector. If there is any doubt that the <br /> application conforms with adopted land use policies and regula- <br /> tions the Director must condition or deny the application. Any <br /> interested person who disagrees with the Director's decision may <br /> request that the application be considered by the Marion County <br /> Hearings Officer after a public hearing. The applicant may also <br /> request reconsideration on the basis of new information subject <br /> to signing a waiver of the 120 day time limit for review of <br /> zoning applications. A public hearing is held on appeals subject <br /> to the appellant paying a $25.00 fee. Requests for reconsider- <br /> ation, or consideration by the Hearings Officer, must be in <br /> writing and be received in the Marion County Plan~in~ DivisiD~, <br /> 220 High Street NE. However, <br />additional farm dwellings must be shown to be necessary for <br />the management of a commercial farm operation. The southern <br />half of the subject property is within the identified 100 <br />year Floodplain of Mill Creek. <br /> <br />The property is located on the south side of Mill Creek Road <br />approximately 600 feet west of its intersection with <br />Leverman Road. The subject property contains a dwelling, <br />shop, and mobile hone. <br /> <br />Surrounding uses consist of small farm and acreage homesites <br />to the north on land zoned SA (SPECIAL AGRICULTURE) and to <br />the east, west, and south on land zoned EFU. <br /> <br />The Soil Conservation Service has identified Class II and IV <br />soils on the property. <br /> <br /> <br />
