improvements provide more capacity than will be needed at the interchange ramps, an <br /> alternative mobility target is included in the TAMP to help preserve the additional capacity <br /> for the next increment of growth beyond the 20-year planning horizon (TAMP Section <br /> 5.6.2). <br /> OAR 660-012-0065(1)states, "This rule identifies transportation facilities, services and <br /> improvements which may be permitted on rural lands consistent with Goals 3, 4, 11, and <br /> 14 without a goal exception." <br /> OAR 660-012-0065(3) lists the transportation improvements that are consistent with <br /> Goals 3, 4, 11, and 14 subject to the requirements of the TPR, including transportation <br /> improvements that are allowed or conditionally allowed by ORS 215.213, 215.283 (a) and <br /> realignment of roads (d). <br /> Widening of roads, including public roads and highway projects, is a permitted use in the <br /> EFU zone where the improvement is accommodated within the right-of-way, does not <br /> remove or replace buildings, and does not create a new parcel. These types of <br /> transportation improvements do not require a Goal Exception. This OAR requirement is <br /> met. <br /> OAR 660-012-0065(4)states, "Accessory transportation improvements required as a <br /> condition of development listed in subsection (3)(a) of this rule shall be subject to the <br /> same procedures, standards and requirements applicable to the use to which they are <br /> accessory." <br /> Construction of additional travel lanes is listed as a conditional use in MCC 17.136.050. <br /> Realignment and widening of Ehlen Road on EFU land in the vicinity of the interchange <br /> does not require a Statewide Goal Exception, but the additional lanes will be subject to a <br /> conditional use review by the County pursuant to MCC Chapter 17.119 Conditional Uses. <br /> This OAR requirement is met. <br /> OAR 660-012-0065(5) requires that for "transportation uses or improvements listed in <br /> subsections (3)(d) to (g) and(o) of this rule within an exclusive farm use (EFU) or forest <br /> zone, a jurisdiction shall, in addition to demonstrating compliance with the requirements <br /> of ORS 215.296: <br /> (a) Identify reasonable build design alternatives, such as alternative alignments, that are <br /> safe and can be constructed at a reasonable cost, not considering raw land costs, with <br /> available technology. The jurisdiction need not consider alternatives that are inconsistent <br /> with applicable standards or not approved by a registered professional engineer; <br /> (b)Assess the effects of the identified alternatives on farm and forest practices, <br /> considering impacts to farm and forest lands, structures and facilities, considering the <br /> effects of traffic on the movement of farm and forest vehicles and equipment and <br /> considering the effects of access to parcels created on farm and forest lands; and <br /> 1-5:Aurora Donald Interchange(Exit 278)TAMP:Supporting Findings for Marion County Adoption 11 <br />
