5. Public facilities, services, and transportation networks. The <br />subject property has city water and sewer service. A condition of <br />approval will require applicants to provide evidence that. any <br />required permits or agreements have been filed with the City of <br />Salem and that any required upgrades to sewer or water service have <br />been made to the City of Salem's satisfaction. Electric and <br />telephone services are available to the site. Marion County Eire <br />District 1 (MCFD1) serves the subject site. Applicants will need to <br />provide proof to the Planning Division, as a condition of.approval, <br />that MCFD1 access and. site identification standards are met. The <br />Marion County Sheriff's Office provides police .services. As noted <br />above, the off-site transportation system in the area.is generally. <br />good. Bicycle and pedestrian ways are in place along portions of <br />45th Avenue, and bus service is available along Silverton Road and <br />at Chemeketa Community College. Blueberry Lane is an easement <br />connecting with the public street system at 45ts Avenue. MCC chapter <br />16.27 contains access requirements and development standards. <br />MCC 16.27.500. Under MCC 16.27:500,. all uses shall be located on a <br />lot having access to a public street. Access to a public street is <br />defined as a minimum of 20 feet of frontage on one of the <br />following: <br />A. A public street with a right-of-way not less.than 20 feet wide <br />throughout that has been. graveled or paved and is open for <br />public use to the subject lot. <br />B. A roadway not less: than 20 feet wide graveled or paved and <br />open for use to the subject lot prior'to the effective date of <br />the ordinance codified in this title and connecting with a <br />public street qualifying under subsection (A) of this section. <br />C. A -roadway not less than 20 feet wide. with an. all --weather <br />surface connecting with.a public street qualifying under <br />subsection _(A) of this section. Where the subject easement <br />provides access to two or more dwellings .or primary uses it <br />must be paved to a width of 12 feet from.the subject property . <br />to a public street. <br />D. A lot in a planned development owned' by the homeowners' <br />association wherein a roadway is provided 'connecting a <br />dwelling to a public street, and the roadway is improved as <br />required in the approval.of the planned development. <br />Partition Plat 99-99.shows Blueberry Lane is an easement and not a <br />public street. MCC 16.27.500(A) -does not apply. <br />MCC 16.49..230 describes a.roadway as'a right-of-way across private <br />property granted by the property owner to.owners of one or more <br />lots and allowing vehicles access from a street or roadway to those <br />lots.
