Blueberry Lane is a roadway not less than <br />20' wide but there is to indication that it was open to the public <br />prior to enactment of the.zoning oxdinance. Based on the evidence <br />in the record,•MCC 16.27.500(B).does not apply. <br />Two dwellings ,already use the roadway., it has a 12' wide paved <br />surface, and it connects to 45' Avenue, a.public street, as defined, <br />in MCC 16.27.500(A). Blueberry' Lane is an access under MCC <br />16.27.500(C). <br />Under MCC 16.49.208, planned development means a subdivision of <br />laud, incorporating common open space, approved pursuant to MCC <br />16.26.800 with each dwelling or mobile home,placed on its own,lot. <br />The subject parcel was created by partition plat and is not in a <br />planned development. MCC 16.27.500'.(D) does not apply.. <br />MCC 16.27.510. Under MCC -16.27.510, no new dwelling or primary use, <br />other than farm or forest use, dependent solely on a roadway far <br />access to a street shall be allowed unless: <br />A. The roadway qualifies as access pursuant. to MCC 16.27.500; and <br />B. The lot upon which the dwelling or use is located was <br />established in accordance with: <br />1. _.County approval of a subdivision, partition or planned <br />development prior to May 1, 1977, or in compliance with <br />state law and county zoning regulations prior to the land <br />division being regulated by the county; or <br />2. County approval of a planned development, or a variance <br />to MCC 17.110.800, after May 1., 1977, and prior. to the <br />effective date of the ordinance codified in this title; <br />or <br />3. County approval of a planned development, after the <br />effective date of the ordinance codified in this title; <br />and . <br />4. There are four or less dwellings or.independent primary <br />uses (other than farm or forest use without a dwelling) <br />depending solely on the roadway for access.to a street. <br />As noted .above; Blueberry bane qualifies "as access under MCC <br />16.27.500(C). MCC 16.27.51b(A) is met. <br />The subject parcel was created by partition in 1999, and not.prior <br />to 1977 nor prior to partitioning regulation. MCC 16.27.510(B).(1) <br />does not apply. <br />
