the necessary construction permits. Applicant's engineer should contact Public Works for <br />scoping information prior to any design work. <br />Condition B - Show sufficient dedicated right-of-way (R/W) on the plat to provide the public <br />R/W half -width of 34 feet for an urban Collector road along the entire subject property 45th <br />Avenue NE frontage. <br />R/W dedication requirements for partitioning are in accordance with Section 33 of the Urban <br />Zone Code of Marion County. It appears that there is currently a deficiency in half -width. The <br />R/W dedication shall be shown as a 34 -foot half -width on the final plat. All dedications shall <br />be to the public, not Marion County. The nexus for this requirement is the proposed addition of <br />traffic, including pedestrians, which necessitate these minor roadway improvements. <br />The following comments, lettered C through I, are informational only regarding County <br />requirements and issues that the applicant must address if the proposal is approved. They are <br />not part of the land use decision-making process. <br />C. Access from 45th Avenue NE to the development shall be via the reciprocal access <br />easement, Blueberry Lane NE. In accordance with Marion County Driveway <br />Ordinance #651, if this land use action is approved, the applicant will also be required <br />to obtain an "Access Permit" at the time of application for a home building permit on <br />the proposed rear parcel. Driveways must meet sight distance, design, spacing, and <br />safety standards. <br />D. The applicant shall provide evidence of a recorded Declaration of Covenants for Road <br />Maintenance Agreement (RMA) regarding the shared access easement, Blueberry Lane <br />NE. The RMA shall reference the easement's name. Public Works needs to review, <br />approve and sign the RMA prior to recordation if a recorded RMA does not currently <br />exist that is linked to subject property. Please contact Public Works Engineering at <br />(503) 584-7714 for details. <br />E. The subject property is within the Urban Growth Boundary of the City of Salem. Per <br />Marion County Ordinance #97-39R, Systems Development & Parks Charges (SDCs) <br />will be assessed upon application for a home building permit on the proposed rear <br />parcel. <br />F. A storm drain "Lynch Box" type catch basin and ductile iron pipe system were installed <br />along the southern edge of the Blueberry Lane NE paved surface to route discharge <br />directly to the 45th Avenue NE closed drainage system. The catch basin and pipe is a <br />preliminary installation phase of a stormwater detention system intended to <br />accommodate for future subdividing on the subject property and/or adjoining north <br />property. Roof drains from a future home on the proposed rear shall be tied directly <br />into this box. It was noted during a field visit that standing water was present within the <br />area of the proposed rear parcel. <br />G. Stormwater detention to accommodate future subdivision development on either side of <br />Blueberry Lane NE was planned to occur within what was to be an inverted crown <br />section of Blueberry Lane NE, although the easement was not constructed with such a <br />cross-section. Stormwater detention will not be required at this time for the P10-003 <br />
