4. The applicant proposes to divide a 41,382 square foot property into two parcels of 19,602 <br />square feet and 21,780 square feet each. The existing dwelling will remain on the smaller <br />parcel. <br />5. Marion County Department of Public Works reviewed the proposal and provided the following <br />comments: <br />"Public Works Engineering requests that the following conditions, lettered A and B, be <br />included in the approval of the land use case: <br />Urban frontage improvements along the subject parcel are appropriate given the added vehicle <br />and pedestrian traffic associated with the additional home site, however, this parcels' frontage <br />(90 -feet) is located in the middle of a short section (260 -feet) of unimproved frontage located <br />between two fairly significant sections of urban improvements (total of 620 -feet). To ensure <br />that the Applicant's frontage is constructed in the correct location and at the appropriate <br />elevation and grade, the Applicant would have to design the 260 -foot missing section in order <br />to obtain the approval to construct their frontage only. To avoid a disproportionate impact to <br />the Applicant, Engineering is requesting Condition A as shown below. <br />Condition A — Enter into a recordable, legally binding Public Improvement Agreement <br />regarding funding roadway frontage improvements, including paving, curb/gutter, sidewalk and <br />drainage to Marion County standards along the subject property frontage on 45th Avenue NE at <br />a more appropriate date. <br />The Public Improvement Agreement will require the applicant and/or their heirs, successors <br />and assigns, to participate financially to a level proportional to the costs of their frontage <br />improvements at the time a County project or County -approved third party project is developed <br />that would include the subject property frontage. A recordable agreement will be provided by <br />Marion County Public Works. <br />In lieu of entering into a Public Improvement Agreement as described above, the applicant has <br />the following option: <br />Optional Condition A — Improve the 45th Avenue NE subject property frontage (approximately <br />90 feet plus required tapers and transitions) to current County and City of Salem standards for <br />an urban Collector road prior to plat approval. To ensure the appropriate design parameters, <br />this will require that the applicant provide Marion County Public Works an acceptable <br />engineering design that addresses the entire xxx-foot section between, and fully incorporates <br />the existing facilities located at, 3785-3815 45th Avenue NE to the north and 4420-4480 Seaton <br />Lane to the south. <br />Urban improvements are to be constructed in accordance with appropriate standards as directed <br />by Public Works as a condition for final plat approval. This would include such elements as <br />pavement widening to accommodate the ultimate cross-section including travel lanes, half of a <br />two-way center left -turn lane, bike lanes, curb/gutter, property line sidewalk, closed system <br />drainage work, landscape strip, and any tapers or transitions required. Submission of <br />engineering plans to the County for review and approval will be required, as well as obtaining <br />
