with a 30 foot radii connecting to the street. In addition a Road Maintenance Agreement will <br />be required for the access easement. <br />Accordim, to the Marion County Addressing Ordinance the new public road must be named <br />and all properties being served by that road must be addressed from this street. In coordination <br />with the 911 Dispatch Center, the Planning Division has approved the name "Stacy Place NE" <br />for the new public street. <br />12. Blocks and lots: These standards are listed in Chapter 33.36-.44. Section 33.36 provides that <br />blocks shall not exceed 600 feet between intersections unless there are topographical or other <br />physical features that justify a greater length. Within this development the block length will <br />not exceed the standards. <br />Section 33.40 (Lot Size) requires that all proposed lots be of sufficient size to accommodate the <br />proposed use and will comply with the ordinance standards. The minimum lot size within the <br />Salem Urban Growth Boundary for lots in the RS zone is 4,000 square feet and the minimum <br />lot dimension is an average width of 40 feet and an average depth of 70 feet. All of the <br />proposed lots will meet the minimum square foot and dimension standards. <br />Although the lots meet the minimum dimension and size standards, due to the fire district <br />turnaround the dwelling placed on lot 5 can not meet the required 12 foot setback. The <br />applicant is requesting a major adjustment to reduce this setback to 5 feet. <br />13. The criteria for a major adjustment are found in MCUZO 41.04 and include: <br />a) The degree of adjustment from the standard is the minimum necessary to permit <br />development of the property for the proposed use; and <br />b) The adjustment will not have a significant adverse affect on property or <br />improvements in the neighborhood of the subject property; <br />(c) The adjustment will not have a significant adverse affect upon the health or safety <br />or persons working or residing in the vicinity; <br />(d) The adjustment will maintain the intent and purpose of the provision being varied <br />14. The reduced setback would be along the north leg of the turnaround that juts into the proposed <br />lot, the required setback would be met from the main (east -west) portion of the easement. Due <br />to the size and shape of the property and the need for an approved turnaround area, it is not <br />possible to develop lot 5 without reducing the setback. Reducing the setback for this lot should <br />have no adverse on property or improvements in the neighborhood and the health and safety of <br />persons working or residing in the vicinity. The purpose of the setback is to provide adequate <br />separation from roadway to a dwelling. In this circumstance only one leg of the turnaround <br />area will closer than 12 feet to the dwelling at it ends almost at the building site. There will be <br />no throuoh traffic along the side of the house and only occasional use of the turnaround. The <br />adjustment will meet the purpose and intent of the provision. <br />15. During deliberations the Commission discussed the concerns of public works regarding the <br />need for more parking. The applicant indicated that additional head in parking spaces could be <br />
