A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br />555 Court St. NE, 2nd Floor, Salem, by 4:30 p.m. on FEBRUARY 23, 2004. Please note an <br />appeal directly to the Land Use Board of Appeals is not allowed under ORS 197.830. This decision is effective FEBRUARY 24, 2004 <br />unless further consideration is requested. <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning <br />Director based the decision are noted below. <br />1. The property is located in the Salem/Keizer Urban Growth Boundary (UGB) and is <br />designated Single Family Residential in the Salem Area Comprehensive Plan (SACP). <br />The parcel is zoned RS (SINGLE FAMILY RESIDENTIAL) under the jurisdiction of <br />Marion County. <br />2. The property is located on the north side of Hayesville Drive NE approximately 600 feet <br />east of the intersection of Hayesville Drive and Lancaster Drive. The property is <br />undeveloped. The parcel was legally created as Lot 2 of Partition Case #03-19. <br />3. Surrounding properties in all directions are zoned RS and consist of developed residential <br />lots. <br />4. The applicants propose to divide a 20,578 square foot parcel into three parcels containing <br />6,560 square feet, 6,560 square feet, and 7,438 square feet each. Access to the parcels is <br />from a private easement along the eastern boundary of the property. <br />Marion County Department of Public Works commented: <br />"Approval of the proposal will create two additional home sites on the subject property <br />resulting in additional traffic on Hayesville Drive. The Public Works Department has the <br />following comments, requirements, and recommendations for the proposed partition: <br />1. In accordance with Marion County Driveway Ordinance #651, driveway permits <br />will be required for any new access or change in existing access. to the public <br />right-of-way. Through the building permit process, the applicant shall be required <br />to apply for a driveway permit. <br />2. Prior to issuing any building permits, the applicant shall construct the required <br />storm detention improvements for Partition Case P 03-19. <br />3. All roof drains shall connect to the storm detention system. <br />4. Prior to obtaining any building permits, the applicant shall have the partition plat <br />recorded." <br />
