(d) Setbacks for accessory structures shall be as provided in Chapter 28. <br />(e) Yards for Planned Developments and Mobile Home Parks shall be as <br />provided in Chapter 26. <br />MCUZO 2.14 - Within an RS zone the following interior side yards shall be provided: <br />(a) A minimum of 5 feet; provided, inside the Salem/Keizer Urban Growth <br />Boundary, side yards of 0 feet on one side and at least 10 feet on the other <br />side are permitted for zero side yard dwellings (see Section 26.08) when the <br />lot abutting the 0 setback is in the same ownership at the time the dwelling is <br />constructed and the 0 setback will not encroach on any easements. <br />(b) Setbacks for accessory structures shall be as provided in Chapter 28. <br />(c) Yards for Planned Developments and Mobile Home Parks shall be as <br />provided in Chapter 26. <br />MCUZO 2.15 - Within an RS zone the following interior rear yards shall be provided: <br />(a) Within the Salem/Keizer UGB 14 feet for any single-family dwelling and for <br />any portion of any other building not more than 15 feet in height; and 20 feet <br />for any portion of a building greater than 15 feet in height other than a single- <br />family dwelling. <br />(b) Within other urban growth boundaries 24 feet for a single family dwelling <br />and 20 feet for any portion of a building other than a single family dwelling. <br />(c) Setbacks for accessory structures shall be as provided in Chapter 28. <br />(d) Yards for Planned Developments and for Mobile Home Parks shall be as <br />provided in Chapter 26. <br />MCUZO 2.20 - Within an RS zone landscaping requirements are as follows: <br />(a) All portions of required yards lying between a street or roadway and the <br />dwelling, or between the street or roadway and any sight -obscuring fence, <br />wall or hedge located within the required yard, shall be landscaped. <br />(b) All required landscaped areas shall be landscaped as provided in Chapter 29. <br />The site plan submitted with the application indicates that the existing dwelling is 44' or <br />more from Hayesville Drive; this is well within the required 12' front yard setback for <br />both the garage attached to the dwelling and the dwelling. The accessory structure in the <br />front of the dwelling is thirty feet from Hayesville Drive, but will be right on the <br />boundary of the 25' proposed private road. The detached garage on the east side of the <br />dwelling is within the proposed private road. Due to the proposed private road all <br />accessory structures that do not face the east need to be 12' from the private road. If the <br />structures face the east they need to be 20' from the private road. The two proposed <br />vacant lots are over 70' in depth. The applicants are in the process of removing or moving <br />the accessory structures that do not conform to the setback standards. They would be able <br />
