For more information, contact Matt Hendricks <br />at Public Works, (503) 588-5036. <br />APPEAL PROCEDURE: The Marion County Subdivision and Partition Ordinance provides <br />that certain Partition applications be considered first by the County Planning Director. If there is <br />any doubt that the application conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested person who disagrees with the <br />decision may request that the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a reconsideration (one time only and a fee <br />of $200) on the basis of new information subject to signing an extension of the 120 -day time <br />limit for review of zoning applications. <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br />555 Court St. NE, 2nd Floor, Salem, by 4:30 p.m. on AUGUST 11, 2003. Please note an <br />appeal directly to the Land Use Board of Appeals is not allowed under ORS 197.830. This decision is effective AUGUST 12, 2003 <br />unless further consideration is requested. <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning <br />Director based the decision are noted below. <br />1. The property is located approximately 1/4 mile east from the intersection with Lancaster <br />Drive NE and Hayesville Drive NE, in northeast Salem. The subject property is on the <br />north side of Hayesville Drive. It is within the Urban Growth Boundary of City of Salem. <br />The Comprehensive Plan designation is Single Family Residential and the parcel is zoned <br />RS (Single Family Residential) under the jurisdiction of Marion County. The purpose of <br />the comprehensive plan designation and zoning is to allow development of residences <br />with urban services at urban densities. <br />2. The property is located at 4111 Hayesville Dr. NE, Salem, and contains a one-story 1977 <br />single-family dwelling. The dwelling is located towards the front of the parcel on <br />Haysville Drive. There is another structure that was a former dwelling and is currently <br />being used as an accessory structure in the southeastern portion of the property. A <br />detached garage is on the eastern portion of the property. <br />
