OTHER PERMITS~ FEES~ AND RESTRICTIONS: This approval does not remove or <br /> affect any covenants or restrictions imposed on the subject property by deed or other <br /> instrument. The proposed use may require permits and/or fees from other local, State or <br /> Federal agencies. This decision does not take the place of, or relieve the responsibility for <br /> obtaining other permits or satisfying any restrictions or conditions thereon. Site grading shall not impact surrounding <br /> properties in a negative manner. <br /> APPEAL PROCEDURE: The Marion County Subdivision and Partition Ordinance <br /> provides that certain Partition applications be considered first by the County Planning <br /> Director. If there is any doubt that the application conforms with adopted land use policies <br /> and regulations the Director must condition or deny the application. Any interested person <br /> who disagrees with the decision may request that the application be considered by the Marion <br /> County Hearings Officer after a public hearing. The applicants may also request a <br /> reconsideration (one time only and a fee of $200) on the basis of new information subject to <br /> signing an extension of the 120-day time limit for review of zoning applications. <br /> A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Thc Comprehensive Plan designation is Rural Residential. The parcel is zoned AR <br /> (ACREAGE RESIDENTIAL) under thc jurisdiction of Marion County. <br /> <br />2. The property is located at 282 Hylo Road, approximately half a mile east of the <br /> intersection with Liberty Road, south of Salem. Currently, the property contains a <br /> 1974 single-family dwelling. The parcel is a legally created parcel. William & <br /> Margaret Taggart conveyed the subject property to Jerry & Alice Whitaker on July <br /> 12, 1973. The warranty deed can be found in Marion County Records, Volume 756, <br /> page 0502. <br /> <br />3. The surrounding properties to the north, south and west are zoned AR and consist of <br /> single-family dwellings with accessory structures and barns. The property to the east <br /> is zone Special Agriculture (SA). <br /> <br />4. The applicants propose to divide a 5.44-acre parcel into two parcels containing 2.85 <br /> acres and 2.59 acres each. The existing dwelling will occupy the southern parcel. <br /> <br />5.
