NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS <br />CHAPTER 215 REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST <br />PROMPTLY BE FORWARDED TO THE PURCHASER. <br /> <br />NOTICE OF DECISION <br />PARTITIONING CASE NO. 02-25 <br /> <br /> APPLICATION: Application of Jeffrey Icovino and Alicea Conner to divide a 5.44-acre <br /> parcel into two parcels of 2.85 acres and 2.59 acres each in an AR (ACREAGE <br /> RESIDENTIAL) zone located at 282 Hylo Road S, Salem. (T8S; R3W; Section 28DB; Tax <br /> Lot 200). <br /> DECISION: Notice is hereby given that the Planning Director for Marion County has <br /> APPROVED the above described Partitioning application subject to certain conditions. <br /> EXPIRATION DATE: This approval is valid only when the final partitioning plat is <br /> recorded by DECEMBER 3~ 2004. After recording the final partitioning plat, the applicants <br /> shall provide proof of the recording to the Planning Division. This can be either a copy of <br /> the recording fee receipt or a copy of the plat showing the County Clerk's stamp. The <br /> effective period of an approved application may be extended for an additional year subject to <br /> approval of an extension (Extension form available from the Planning Division). Additional <br /> extensions may not be granted ff the regulations under which this decision was granted <br /> have changed since the original approval. <br /> WARNING: A decision approving the proposed division or use is for land use purposes <br /> only. Due to septic, well, and drain field replacement areas, these parcels may not be able to <br /> support a dwelling. To be sure the subject property can accommodate the proposed use the <br /> applicants need to check with the Building Inspection Division, (503) 588-5147. <br /> This decision does not include approval of a building permit. <br />CONDITIONS: The following conditions must be met before a building permit can be <br />obtained or the approved use established: <br />1. The applicants shall submit a survey per ORS 92.050, and a plat must be submitted <br /> for review to the County Surveyor's Office (5155 Silverton Road NE, 503 588-5155). <br />2. The applicants shall submit a final partitioning plat to the County Surveyor's Office, <br /> along with required fees and a Plant Service report and/or title report. Following plat <br /> approval, it shall be recorded with the Marion County Clerk (final plat instructions <br /> and example enclosed). <br />3. Prior to plat approval, the applicants shall submit a plat showing sufficient right-of- <br /> way dedicated to the public along Hylo Road S. For more information, contact Byron <br /> Meadows at Public Works, (503) 588-5036. <br />4. Prior to issuance of building permits the applicants shall obtain driveway permits and <br /> access from Marion County Public Works. <br />5. The applicants shall obtain all necessary permits from Marion County Building <br /> Division. <br />6. All taxes due must be paid in full to the Marion County Tax Department prior to plat <br /> being recorded. <br />ADDITIONAL CONDITIONS: Once the approved use is established the following <br />conditions must be continually satisfied: <br /> <br />7. After the final partitioning plat has been recorded no alteration of property lines shall <br /> be permitted without first obtaining approval from the Planning Director. <br />8. The applicants shall contact the Salem Fire District to obtain all necessary <br /> information for road access, road requirements, and address labeling. <br /> <br /> <br />
