The applicant is <br />advised of the following: <br /> <br />The applicant should contact Marion County Fire District No. 1 and obtain a copy of the <br />District's Recommended Building Access and Identification Guidelines. For personal <br />and property safety it is recommended that the applicant follow these guidelines. Fire <br />District access standards may be more restrictive than County standards. Paula Smith at <br />MCFD#1/(503)588-6513 is the contact person. <br /> <br />APPEAL PROCEDURE: The Marion County Subdivision and Partition Ordinance provides <br />that certain Partition applications be considered first by the County Planning Director. If there is <br />any doubt that the application conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested person who disagrees with the <br />decision may request that the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a reconsideration (one time only and a fee <br />of $200) on the basis of new information subject to signing an extension of the 120 day time <br />limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br />555 Court St. NE, 2nd Floor, Salem, by 4:30 p.m. on NOVEMBER 7~ 2002. Please note <br />an appeal directly to the Land Use Board of Appeals is not allowed under ORS 197.830. If you <br />have any question about this application or the decision please call (503) 588-5038 or visit the <br />County Plarming Office at the above address. This decision is effective NOVEMBER 8~ <br />2002 unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning <br />Director based the decision are noted below. <br /> <br />The property is in the Salem/Keizer Urban Growth Boundary (UGB) and is designated <br />Single Family Residential in the Salem Area Comprehensive Plan (SACP). The parcel is <br />zoned RS (SINGLE FAMILY RESIDENTIAL) under the jurisdiction of Marion County. <br /> <br />The property is located on the north side of Hagar Street SE, approximately 350 feet east <br />of its intersection with Lancaster Drive SE. The property was the subject of a previous <br />land use case, Major Partitioning/Variance Case No. 81-43 (MP/V81-43), which denied a <br />request to divide the subject property into three parcels. The property contains a single <br />family dwelling that was constructed under a building permit issued for the subject <br />property in December, 1981. Based on land use and building history of the property the <br />parcel is considered lawfully created. <br /> <br />Surrounding properties to the north, east, and south consist lots of in a developed <br />residential subdivision that is zoned RS. Property to the west is zoned CO <br />(COMMERCIAL OFFICE) and its northern part is developed with a parking lot. <br /> <br /> <br />
