A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br />555 Court St. NE, 2na Floor, Salem, by 4:30 p.m. on NOVEMBER 5, 2002. If you have <br />any question about this application or the decision please call 588-5038 or visit the County <br />Planning Office at the above address. This decision is effective NOVEMBER 6~ 2002 <br />unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Director based <br />his decision are noted below. <br /> <br />The property is designated Rural Residential in the Marion County Comprehensive Plan. <br />The purpose of this designation and the corresponding AR (Acreage Residential) zone is <br />to allow for the creation of acreage homesites at a density that maintains the character <br />and environmental quality of the County's rural residential areas. The property is also <br />located in a Sensitive Groundwater Overlay Zone (SGO~5) as well as a Geologically <br />Hazardous Areas Overlay Zone. <br /> <br />The subject parcel is located on the west side of River Springs Drive S, approximately ½ <br />mile south of its intersection with Vitae Springs Road S. It is currently vacant land. The <br />parcel was lawfully created with Marion County approval of Partitioning Case//99-1 and <br />is recorded as Parcel 2 of Partitioning Plat No~ 2001-65. <br /> <br />¸3. <br /> <br />Surrounding properties to the north, east and south are zoned AR and consist of rural <br />residential lots. Property to the west is zoned SA (SPECIAL AGRICULTURE) and is <br />devoted to forest use. <br /> <br />The applicant proposes to divide a 4.36 acre parcel into two parcels containing 2.18 acres <br />and 2.18 acres each. The property is undeveloped. Access to the proposed easterly <br />parcel will be via a newly created easement across the properties to the east and north. <br />The new easement will also serve a partitioning filed by the applicant for the adjacent <br />parcel (tax lot 903) that is currently under review (P02-22). The new easement will <br />constitute realignment and renaming of Fern Forest Lane S that was created by P99-1. <br />The applicant states that the proposed westerly parcel is to access from an existing <br />easement also shown on P99-1 as an extension of Fern Forest Lane and will serve only <br />one parcel. Subsequently, an existing portion of Fern Forest Lane S will continue to <br />serve the newly created westerly parcel. It should be noted that the property is heavily <br />wooded, and excessive topographic limitations exist at the site. <br /> <br />Marion County Department of Public Works reviewed the proposal and provided the <br />following comments: <br /> <br />"Approval of the proposed partition will create an additional home site on the <br />subject property resulting in additional traffic on River Springs Rd.
