3. Under MCUZO 43.00(a), a nonlegislative comprehensive plan <br />amendment involves only a change to the land use designation of <br />four or fewer different ownerships and 15 or fewer acres. <br />This amendment involves one ownership and the affected area is <br />only 0.97 acres. This is a nonlegislative plan amendment. <br />4. MCUZO 43.02 contains the following criteria for nonlegislative <br />plan amendments: <br />(a) Conformance with the comprehensive plan goals, policies and <br />intent, and any plan map amendment criteria in the plan, or <br />intergovernmental planning coordination agreement, pertaining <br />to unincorporated lands. <br />(b) The addition of the subject property to the inventory of <br />lands in the proposed map designation and the corresponding <br />inventory reduction in the current designation are consistent <br />with projected needs for such lands in the comprehensive <br />plan. .- <br />(c) Uses allowed in the proposed designation will not <br />significantly adversely affect planned uses on adjacent <br />lands. <br />(d) Public facilities and services necessary to support uses <br />allowed in the proposed designation are available or are <br />likely to be available in the near future. <br />5. The subject property is within the Salem UGB, but outside of the <br />Salem city limits, and is subject to the SACP. According to <br />intergovernmental agreement, the SACP is administered by Marion <br />County for unincorporated lands inside the Salem UGB. Under SACP <br />and MCCP coordination policies, this proposal was forwarded to the <br />City of Salem for comment and recommendation. The City of Salem <br />commented extensively on the proposal as noted above. <br />The intent of the SACP is to project the most desirable pattern <br />of land use for the Salem area. Use designations take into <br />consideration the transportation network, location of public <br />facilities and utility systems, and the needs of the people. <br />Specific use designations are provided for by annexation and <br />rezoning in response to demand for specific land uses, the plan <br />policies and intent statement, and implementing regulations and <br />processes. <br />The Multi -Family Residential designation applies to the portion <br />of the Salem urban area that is currently developed with housing <br />or served by public facilities and suitable for residential <br />ZC/CPO1-1\ORDER - 7 <br />LUNDEEN <br />
