If Marion County chooses <br />City staff recommends that <br />conditions of approval <br />applicant: <br />to approve the application, <br />the following be attached as <br />to be completed by the <br />A. Convey for the distance Silverton Road abuts the <br />property, sufficient land to allow for dedication of <br />right-of-way 48 feet in width measured from the street <br />centerline. <br />B. Convey for the distance Hollywood Drive abuts the <br />property, sufficient land to allow for dedication of <br />right-of-way 30 feet in width measured from the street <br />centerline. <br />C. Apply with the City of Salem for connection to public <br />water and pay the required connection fees at the time <br />of development. Eight (8) inch lines are available in <br />Silverton Road and Hollywood Drive. <br />D. Apply with the City of Salem Public Works Department <br />for connection to public sewer and pay the required <br />fees at the time of development. Eight inch lines are <br />available in Silverton Road and Hollywood Drive. No <br />connections to the 54 inch lines or 18 inch force main <br />are permitted. <br />E. At the time of development beyond the existing use or <br />new construction, the access to both lots on Silverton <br />Road shall be closed and access to the property shall <br />be via Hollywood Drive. <br />All other responding agencies stated no objection to the proposal. <br />V. Additional Findings of Fact and Conclusions of Law <br />1. According to MCUZO 36.12(a), applicants have the burden of proving <br />that the standards and criteria relevant to each requested land <br />use action have been satisfied. <br />COMPREHENSIVE PLAN AMENDMENT <br />2. All comprehensive plan amendments are subject to review by the <br />Oregon Department of Land Conservation and Development (DLCD). <br />DLCD was notified as required by state law and had no comment on <br />the application. <br />ZC/CPO1-1\ORDER - 6 <br />LUNDEEN <br />
