Ex. 4 June 19, 2001 letter from Tim Worley, with attached June 12,
2001 and June 19, 2001 letters from David L. Winegardner
No objections were raised as to notice, jurisdiction, conflicts
of interest, or to evidence or testimony presented at the hearing.
IV. Findings of Fact
The hearings officer, after careful consideration of the testimony
and evidence in the record, issues the following findings of fact:
1. The subject property is within the Salem/Keizer Urban Growth
Boundary (UGB) and designated Multi -Family Residential in the
SACP. The property is zoned UD and is under the jurisdiction of
Marion County.
2. The subject parcel is on the southeast corner of the Hollywood
Drive - Silverton Road NE intersection. The property contains a
commercial building in use as a tavern, a garage and a paved
parking lot. To the east of the paved parking area -1s a gravel
parking lot and an undeveloped area.
3. Property to the south is zoned RL (LIMITED MULTIPLE FAMILY
RESIDENTIAL) and contains an apartment complex. To the north,
across Silverton Road, is an auto repair business and a single
family dwelling on property zoned IG -LU (GENERAL INDUSTRIAL -
LIMITED USE OVERLAY), and undeveloped P (PUBLIC) zoned property
owned by Chemeketa Community -College (CCC). A UD zoned parcel is
to the west. To the east is an auto repair business in a UD zone,
and a storage facility zoned CG -LU (COMMERCIAL GENERAL -LIMITED
USE OVERLAY).
4. Applicant asks to change the MCCP designation from Multi -Family
Residential to Commercial and the zoning from UD to CR.
5. The Marion County Planning division requested comments on the
application from various governmental agencies.
The Marion County Department of Public Works (DPW) commented:
Approval of the proposed zone change will create
additional commercial property resulting in additional
traffic on Silverton Road and Hollywood Drive. The
following requirements address impacts created by
approval of the proposed zone change.
1. Silverton Road is designated as an urban arterial
road with a standard half right-of-way width of 48
feet. Hollywood Drive is designated as an urban
ZC/CPO1-1\ORDER - 2
LUNDEEN
