Winegardner <br />No objections were raised as to notice, jurisdiction, conflicts <br />of interest, or to evidence or testimony presented at the hearing. <br />IV. Findings of Fact <br />The hearings officer, after careful consideration of the testimony <br />and evidence in the record, issues the following findings of fact: <br />1. The subject property is within the Salem/Keizer Urban Growth <br />Boundary (UGB) and designated Multi -Family Residential in the <br />SACP. The property is zoned UD and is under the jurisdiction of <br />Marion County. <br />2. The subject parcel is on the southeast corner of the Hollywood <br />Drive - Silverton Road NE intersection. The property contains a <br />commercial building in use as a tavern, a garage and a paved <br />parking lot. To the east of the paved parking area -1s a gravel <br />parking lot and an undeveloped area. <br />3. Property to the south is zoned RL (LIMITED MULTIPLE FAMILY <br />RESIDENTIAL) and contains an apartment complex. To the north, <br />across Silverton Road, is an auto repair business and a single <br />family dwelling on property zoned IG -LU (GENERAL INDUSTRIAL - <br />LIMITED USE OVERLAY), and undeveloped P (PUBLIC) zoned property <br />owned by Chemeketa Community -College (CCC). A UD zoned parcel is <br />to the west. To the east is an auto repair business in a UD zone, <br />and a storage facility zoned CG -LU (COMMERCIAL GENERAL -LIMITED <br />USE OVERLAY). <br />4. Applicant asks to change the MCCP designation from Multi -Family <br />Residential to Commercial and the zoning from UD to CR. <br />5. The Marion County Planning division requested comments on the <br />application from various governmental agencies. <br />The Marion County Department of Public Works (DPW) commented: <br />Approval of the proposed zone change will create <br />additional commercial property resulting in additional <br />traffic on Silverton Road and Hollywood Drive. The <br />following requirements address impacts created by <br />approval of the proposed zone change. <br />1. Silverton Road is designated as an urban arterial <br />road with a standard half right-of-way width of 48 <br />feet.
