EXHIBIT A <br />BEFORE THE MARION COUNTY HEARINGS OFFICER <br />In the Matter of the ) Case No. CP/ZC 01-1 <br />Application of: ) Clerk's File No. <br />MICHELLE LUNDEEN ) Zone Change/Comprehensive <br />Plan Amendment <br />RECOMMENDATION <br />I. Nature of the Application <br />This matter comes before the Marion County Hearings Officer on the <br />application of Michelle Lundeen to change the zone from UD (URBAN <br />DEVELOPMENT) to CR (COMMERCIAL RETAIL) and to change the Comprehensive <br />Plan designation from Multiple Family Residential to Commercial on 0.97 <br />acres at 4310 Silverton Road NE, Salem, Marion County, Oregon (Section <br />18AB; T7S; R2W; Lots 800 and 801). <br />II. Relevant Criteria <br />The standards and criteria relevant to this application are found <br />in the Salem Area Comprehensive Plan (SACP) and the Marion County Urban <br />Zoning Ordinance (MCUZO), especially chapters 39 and 43. <br />III. Public Hearing <br />A public hearing was duly held on this application on May 9, 2001. <br />At the hearing, the Planning Division file was made part of the record. <br />The record remained open until May 23, 2001 for applicant to submit <br />additional information. On applicant's request, the open record period <br />was extended to May 30, June 6, and June 20, 2001. On June 21, 2001, <br />the hearings officer received additional information from applicant, <br />and this was considered a request to extend the open record period for <br />one day. The following persons appeared at the hearing and provided <br />testimony on the application: <br />1. Norm Bickell Planning Division <br />2. Michelle Lundeen Applicant <br />3. Frank Walker Proponent <br />4.
