identified as lacking. But, here, the request is to remove only <br />a small amount of land from the Multi -Family designation and add <br />it to the Commercial designation. The land in this case is <br />developed with and occupied by a long standing commercial use. The <br />effect upon the Commercial and Multi -Family inventory will be <br />negligible, and MCUZO 43.02(b) is met. <br />7. The Commercial designation provides for several types of uses at <br />varying degrees of intensity. The current use of the property may <br />be compatible with surrounding uses, but other types of commercial <br />uses may not be compatible. Landscaping, setbacks, screening and <br />other provisions can help residential -commercial compatibility. <br />Examination of some uses under a conditional use process to <br />determine impacts on adjacent properties will be necessary. With <br />a limited use overlay zone, MCUZO 43.02(c) can be met. <br />8. The subject parcel fronts an arterial street. Other services, such <br />as public transportation, water, sewer, telephone and electricity <br />are available to the subject property. MCUZO 43.02(d) is met. <br />ZONE CHANGE <br />9. According to MCUZO 39.01, the hearings officer is authorized to <br />make initial decisions on zone change applications. Since this <br />zone change application is accompanied by a comprehensive plan <br />amendment application requiring action by the governing body, the <br />hearings officer makes only a recommendation to the governing body <br />concerning this application. <br />10. MCUZO 39.05 contains the following criteria for approval of a zone <br />change application: <br />(a) The proposed zone is appropriate for the Comprehensive Plan <br />land use designation on the property and is consistent with <br />the description and policies for the applicable Comprehensive <br />Plan land use classification. <br />(b) Adequate public facilities, services, and transportation <br />networks are in place, or are planned to be provided <br />concurrently with the development of the property. <br />(c) Satisfaction of any zone change review criteria in the <br />applicable city Comprehensive Plan pertaining to <br />unincorporated lands is demonstrated. <br />(d) The criteria listed in the purposed statement for the <br />proposed zone shall be met (see Chapters 2 through 23). <br />ZC/CP01-1\ORDER - 15 <br />LUNDEEN <br />
