(e) If the proposed zone allows uses more intensive than uses in <br />other zones appropriate for the land use designation, the <br />proposed zone will not allow uses that would significantly <br />adversely affect allowed uses on adjacent properties zoned <br />for less intensive uses. <br />11. If the comprehensive plan amendment is approved, the zone change <br />will be appropriate to the comprehensive plan designation. As <br />noted above, with conditions of approval, the subject proposal is <br />consistent with the SACP. MCUZO 39.05(a) is satisfied. <br />12. As noted above, services are or can be made available to serve the <br />proposed use at its current level. A limited use overlay should <br />be employed to ensure adequate facilities are in place for other <br />uses of the site. MCUZO 39.05(b) is satisfied. <br />13. No zone change criteria are contained in the SACP. MCUZO 39.05(c) <br />is not applicable. <br />14. According to MCUZO 6.00, the purpose of the CR zone is -to provide <br />areas suitable for professional and general commercial offices, <br />retail sales within a building, eating and drinking places, <br />commercial accommodations and commercial services. The CR zone is <br />appropriate in those areas designated Commercial in the applicable <br />urban area comprehensive plan and where the location has access <br />to a collector or arterial street. <br />If the comprehensive plan amendment is approved, the area will be <br />designated Commercial and the CR zone will be appropriate for this <br />designation. The site has direct access onto an arterial street. <br />If the comprehensive plan amendment is approved, and a limited use <br />overlay zone is used to ensure future compatibility of the site <br />with surrounding uses, MCUZO 39.05(d) will be satisfied. <br />15. The CR zone is not the least intensive zone for the Commercial <br />designation. The CO (COMMERCIAL OFFICE) zone is considered a less <br />intensive zone. The CR zone may allow several uses that would not <br />be compatible with adjacent land uses. With a limited use overlay <br />and conditional use review of intensified use of the property, <br />MCUZO 39.05(e) can be satisfied. <br />LIMITED USE OVERLAY <br />16. According to MCUZO 22.01, the purpose of the limited use overlay <br />zone is to reduce the list of permitted or conditional uses in a <br />zone to those that are suitable for a particular location. On a <br />particular property certain uses may conflict with adjacent land <br />uses or may not be considered suitable for a particular site. <br />Rather than deny a zone change because the proposed zone would <br />ZC/CPOI-1\ORDER - 16 <br />LUNDEEN <br />
