(e) If the proposed zone allows uses more intensive than uses in
other zones appropriate for the land use designation, the
proposed zone will not allow uses that would significantly
adversely affect allowed uses on adjacent properties zoned
for less intensive uses.
11. If the comprehensive plan amendment is approved, the zone change
will be appropriate to the comprehensive plan designation. As
noted above, with conditions of approval, the subject proposal is
consistent with the SACP. MCUZO 39.05(a) is satisfied.
12. As noted above, services are or can be made available to serve the
proposed use at its current level. A limited use overlay should
be employed to ensure adequate facilities are in place for other
uses of the site. MCUZO 39.05(b) is satisfied.
13. No zone change criteria are contained in the SACP. MCUZO 39.05(c)
is not applicable.
14. According to MCUZO 6.00, the purpose of the CR zone is -to provide
areas suitable for professional and general commercial offices,
retail sales within a building, eating and drinking places,
commercial accommodations and commercial services. The CR zone is
appropriate in those areas designated Commercial in the applicable
urban area comprehensive plan and where the location has access
to a collector or arterial street.
If the comprehensive plan amendment is approved, the area will be
designated Commercial and the CR zone will be appropriate for this
designation. The site has direct access onto an arterial street.
If the comprehensive plan amendment is approved, and a limited use
overlay zone is used to ensure future compatibility of the site
with surrounding uses, MCUZO 39.05(d) will be satisfied.
15. The CR zone is not the least intensive zone for the Commercial
designation. The CO (COMMERCIAL OFFICE) zone is considered a less
intensive zone. The CR zone may allow several uses that would not
be compatible with adjacent land uses. With a limited use overlay
and conditional use review of intensified use of the property,
MCUZO 39.05(e) can be satisfied.
LIMITED USE OVERLAY
16. According to MCUZO 22.01, the purpose of the limited use overlay
zone is to reduce the list of permitted or conditional uses in a
zone to those that are suitable for a particular location. On a
particular property certain uses may conflict with adjacent land
uses or may not be considered suitable for a particular site.
Rather than deny a zone change because the proposed zone would
ZC/CPOI-1\ORDER - 16
LUNDEEN
