Marion County DPW notes that access from Silverton Road will be <br />consolidated with the neighboring property. A driveway permit from <br />Public Works is required. With a condition of approval requiring <br />a driveway permit, this policy will be met. <br />CONCLUSION: Residential use of the subject property would be <br />difficult, given the existing development and long standing <br />commercial use. SACP policies are met for commercial use of the <br />property at its current type and level of activity. Applicant <br />suggests applying a limited use overlay zone to the site to help <br />ensure compatibility issues are adequately addressed. With use of <br />a limited use overlay as discussed below, and conditions of <br />approval as discussed above, MCUZO 43.02(a) will be satisfied. <br />6. The SACP does not contain information on the need for land <br />designated Multi -Family Residential or Commercial. As noted in <br />comments from the City of Salem, the City has had an identified <br />shortage of Multi -Family Residential land. The City of Salem <br />studied ways to accommodate its long term multi -family residential <br />land requirements, but did not provide specific information on the <br />amount of shortfall, and its strategy for meeting its need. The <br />City remarked simply that the Marion County Board of Commissioners <br />voted to remove 75 acres the City had identified for multiple <br />family housing outside the Salem city limits. The City contends <br />that removal of any property from the multifamily inventory is not <br />consistent with the projected need for multifamily land. The City <br />does not comment on the need for additional commercial land. <br />Applicant attempted to obtain information on the existing lands <br />inventory from the City of Salem, and was referred to the <br />Marion/Salem data center. The data center was unable to give up <br />to date information on land designated for multiple family use. <br />The information supplied by the data center was for 1997. No <br />vacant lands information was available. The figures are broken <br />down into two categories, inside the city limits and inside the <br />UGB. The inside the UGB category appears to include lands within <br />the city limits. The figures appear to be based on zoning rather <br />than comprehensive plan designation. UD land is reserved for a <br />variety of urban development, and is not limited to future <br />residential use. The figures obtained do not reflect designated <br />future uses. Needed and current Multi -Family Residential and <br />Commercial acreage was not provided. <br />It seems less than genuine for the City of Salem to complain that <br />any reduction in Multi -Family Residential designated land will <br />undermine its multiple family land needs when applicant cannot <br />obtain information from the City on how much multiple family land <br />is needed and how much is available.
