State law requires that the county notify property owners within a certain distance from this property. The proposal and <br />address of the property is described in the "Application" section below. The decision in this case does not directly affect the zoning or <br />use of your property. If you object to the decision, refer to the "Appeal" section. If you have questions, contact the staff person listed <br />at the end of this report. <br /> <br />NOTICE OF DECISION <br />ADJUSTMENT CASE NO. 25-013 <br /> <br />APPLICATION: Application of Craig Allen and Tracy Jo Slaughter for an adjustment to the guest house standards to <br />allow a guest house further than 100-feet from the primary dwelling on a 4.80-acre property in an SA Special Agriculture) <br />zone located at 7015 Orville Rd S, Salem (T8S; R4W; Section 26AB; Tax lot 100). <br /> <br />DECISION: The Planning Director for Marion County has APPROVED the above-described Adjustment subject to <br />certain conditions. <br /> <br />EXPIRATION DATE: This decision is valid only when exercised by January 5th, 2027, unless an extension is granted. <br />The effective period may be extended for one year subject to approval of an extension. Request for an extension must be <br />submitted to the Planning Division prior to expiration of the approval (form available from the Planning Division). <br /> <br />WARNING: A decision approving the proposal is for land use purposes only. Due to septic, well and drainfield <br />replacement areas, this parcel may not be able to support the propos al. To be sure the subject property can accommodate <br />the proposed use the applicant should contact the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: <br /> <br />1. The applicants shall obtain all permits required by the Marion County Building Inspection Division. <br /> <br />2. The guest house shall comply will all guest house criteria listed in MCC17.126.020(A)(9), excluding (e). <br /> <br />3. The guest facility shall continuously maintain 114-foot setback from the primary dwelling. <br /> <br />4. The guest house shall maintain a square footage of no more than 600 square feet. <br /> <br />5. The applicant shall sign and submit a “Guest Facility Restrictions and Requirements” Declaratory Statement <br />(form enclosed) to the Planning Division. This statement shall be recorded by the applicant with the Marion <br />County Clerk after it has been reviewed and signed by the Planning Director. <br /> <br />6. A septic authorization is required to connect a proposed guesthouse into the existing septic system. <br /> <br />7. Failure to continuously comply with any conditions may result in the permit being revoked. <br /> <br />OTHER PERMITS, FEES AND RESTRICTIONS: This approval does not remove or affect any covenants or <br />restrictions imposed on the subject property by deed or other instrument. The proposed use may require permits and/or <br />fees from other local, state or federal agencies. This decision does not take the place of, or relieve the responsibility fo r, <br />obtaining other permits or satisfying any restrictions or conditions thereon. The applicants should contact Marion County Land Development and Engineering (503-584-7714) for additional <br />Engineering Requirements and Advisories, listed in Finding #6 below, that may be required. <br /> <br />9. The applicants should contact Polk County Fire District No. 1 (503-838-1510) for further guidelines on fire <br />department access and building requirements as Fire District requirements can be more restrictive than Marion <br />County Building Inspection requirements. <br />
