<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of Harold and ) Case No. M06-320 <br />Elaine Meadors ) <br /> <br /> <br />APPLICATION <br /> <br />The applicants, Harold and Elaine Meadors, request compensation under ORS 197.352 (Measure 37) for <br />being denied a request to subdivide a 33.83 acre parcel into an unspecified number of lots in an EFU <br />(Exclusive Farm Use) zone located at 10604 Wiseacre Lane NE, Aurora (T4S; R1W; Section 29B; tax lot <br />1500). <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Primary Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned EFU in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />2. The property is located 4000 feet east of the intersection with Butteville Road and cntains a <br />dwelling, accessory structures, and farm structures. <br /> <br />3. Adjacent properties are zoned EFU and consist primarily of properties in farm use. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> Woodburn (WuA, WuD) 90% II, III Yes <br /> Amity (Am) 10% II Yes <br /> <br />5. The property has not been the subject of any previous land use cases. <br /> <br />6. The applicants request compensation under Measure 37 for being denied in a land use verification <br />letter dated November 30, 2006, a request to subdivide the subject property. <br /> <br />7. The applicants acquired an ownership interest in the subject property on February 6, 1992, and do <br />not claim prior family ownership. <br /> <br />AGENCY COMMENTS <br /> <br /> <br />Comments on the subject application received from various governmental agencies are summarized <br />below. Marion County Department of Public Works Land Development and Engineering reviewed the <br />proposal and provided the following comments: “Approval of the proposed development would <br />allow the subject property to be divided into an unspecified number of lots, with a dwelling on each <br /> <br />
