<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of SAD, LLC and ) Case No. M06-259 <br />7D Lands, Inc. ) <br /> <br /> <br />APPLICATION <br /> <br />The applicants, SAD, LLC and 7D Lands, Inc., request compensation under ORS 197.352 (Measure 37) for <br />being denied a request to subdivide a 20 acre parcel into an unspecified number of lots with dwellings in an <br />FT (Farm/Timber) zone located at 19500 De Santis Lane, Silverton (T8S; R1E; Section 3; Tax lot 800). <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Farm/Timber in the Marion County Comprehensive Plan and <br />correspondingly zoned FT in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />2. The property is located 3500 feet west of the intersection with Silver Falls Highway and contains <br />manufactured dwellings. <br /> <br />3. Adjacent properties are zoned FT and consist primarily of properties in timber use. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> McCully (McB) 75% II Yes <br /> McCully (McC) 25% III No <br /> <br />5. The property was the subject of the following previous land use case: <br /> <br /> <br />Property Line Adjustment Case #05-49: request to adjust property lines on 8 adjacent <br />o <br />properties. Approved. <br /> <br />6. The applicants request compensation under Measure 37 for being denied in a land use verification <br />letter dated November 3, 2006, a request to subdivide the subject property. <br /> <br />7. From the chain of title report submitted with the applicant, it appears applicant 7D Lands, Inc. never <br />acquired an ownership interest in the subject property (tax lot 800). Applicant SAD, LLC acquired <br />an ownership interest in the subject property on October 16, 2002, and claims prior family <br />ownership back to 1948. However, an LLC does not have a mother, father, brother, brother-in-law, <br />etc. Although Anthony and Sharon DeSantis deeded the property to the LLC they are not "family <br />members" of the current owner and there is no prior family ownership. <br /> <br /> <br /> <br /> <br />
