Ray Daniels ) Case No. M06-131 <br /> ) <br /> <br /> <br />APPLICATION <br /> <br />The applicant, J. Ray Daniels, requests compensation under Measure 37 for being denied a request to <br />subdivide a 9.73 acre parcel into 6 lots and place a dwelling on the resulting vacant parcels in a SA <br />(SPECIAL AGRICULTURE) zone located a 3770 Wiltsey Street SE, Salem (T8S; R2W; Section 19B; tax <br />lots 200 and 1100). <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Special Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned SA in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />2. The property is located on the south side of Wiltsey Street SE approximately 850 feet east of the <br />th <br />intersection with 36 Avenue SE. The property contains an existing dwelling, accessory structures, <br />well, and septic system. <br /> <br />3. Adjacent properties to the south, east, and west are zoned SA and consist primarily of parcels in <br />agriculture production. Property to the north is zoned RS and UT-5, located within the Salem Area <br />Urban Growth Boundary, and in rural residential use. <br /> <br />4.
