7. The applicant, J. Ray Daniels, first acquired an ownership interest in tax lot 1100 on December 7, <br />1959 and September 17, 1962 for tax lot 200. Mr. and Mrs. Daniels transferred ownership to West <br />Coast Trust Company, as Trustee of the Survivor’s Trust with J. Ray and Mary Lou Daniels as <br />trustors, on April 17, 1998. The applicant does not claim prior family ownership. <br /> <br />AGENCY COMMENTS <br />: <br /> <br />Comments on the subject application received from various governmental agencies are summarized <br />below. The full comments can be reviewed in the planning file. <br /> <br />8. Marion County Department of Public Works Land Development and Engineering reviewed the <br />proposal and provided the following comments. “Approval of the proposed development would <br />allow the subject property to be divided into six parcels, with a dwelling on each parcel, resulting in <br />approximately 60 additional daily trips on Wiltsey Street and other roads in the area. Comments are <br />based on this level of development; changes in development level may result in changes in <br />requirements and/or mitigation measures. The Public Works Engineering Division has the following <br />comments, recommendations, and requirements for this case: <br /> <br />S <br />TREETS <br />In accordance with the Rural Zoning Ordinance of Marion County, Oregon, the applicant would be <br />required to dedicate sufficient right-of-way on the plat to provide standard public dedicated right-of- <br />way width (or half-width as appropriate) along Wiltsey Street. Any dedications shall be to the <br />public, not Marion County. Additional width shall be provided if necessary to allow any cut or fill <br />slopes, or roadside ditches, to be within the right-of-way. <br /> <br />If this development proceeds, prior to plat approval the developer will be required to improve their <br />frontage of Wiltsey Street to County standards as directed by the Public Works Department. This is <br />anticipated to include gravel shoulders, vegetation clearing, slope work, drainage work, and may <br />include some paving. <br /> <br />Due to the steep slopes in the area, it will be difficult to find a safe location for access to the subject <br />property. It will be necessary to construct a safe driveway for development to be allowable. Prior <br />to plat approval, the developer will need to obtain Public Works approval of a safe, compliant, and <br />feasible access configuration for each parcel. This may necessitate shared access easements with <br />other parcels and/or adjacent properties. <br /> <br />In accordance with Marion County Driveway Ordinance #651, driveway permits will be required for <br />any new access or change in use of the existing access to the public right-of-way. If this <br />development occurs, the developer will be required to obtain driveway permits. Driveways must <br />meet County Standards to establish safe and compliant access. The newly created parcels will need <br />to share a common access to Wiltsey Street. <br /> <br />A Road Maintenance Agreement will be necessary for shared accesses to the subject property <br />(contact Tedd Joling at (503) 584-7714 for details). <br /> <br />Driveways will also need to meet fire district standards for emergency access. <br /> <br /> <br />
