NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER <br />215 REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE <br />FORWARDED TO THE PURCHASER. <br /> <br /> NOTICE OF DECISION <br /> PARTITIONING CASE NO. 02-30 <br />APPLICATION: Application of Kelly & Michael Swift to divide a 9.77 acre parcel into 3 <br />parcels containing 2 acres, 2 acres, and 5.77 acres each in an AR (Acreage Residential) zone <br />located at 11971 Irish Glen Lane, Aumsville. (T8S; R1W; Section 28C; Tax Lot 300) <br /> <br />DECISION: Notice is hereby given that the Planning Director for Marion County has <br />APPROVED the above described Partitioning application subject to certain conditions. <br /> <br />EXPIRATION DATE: This approval is valid only when the fmal partitioning plat is recorded <br />by ~ 005. After recording the final partitioning plat, the applicants shall <br />provide proof of the recording to the Planning Division. This can be either a copy of the <br />recording fee receipt or a copy of the plat showing the County Clerk's stamp. The effective <br />period of an approved application may be extended for an additional year subject to approval of <br />an extension (Extension form available from the Planning Division). Additional extensions <br />may not be granted if the regulations under which this decision was granted have changed <br />since the original approval. <br /> <br />WARNING: A decision approving the proposed division or use is for land use purposes only. <br />Due to septic, well, and drain field replacement areas, these parcels may not be able to support a <br />dwelling. To be sure the subject property can accommodate the proposed use the applicants need <br />to check with the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br /> CONDITIONS: The following conditions must be met before a building permit can be obtained <br />or the approved use established: <br /> <br />2. The applicants shall submit a final partitioning plat to the County Surveyor's Office, <br /> along with required fees and a Plant Service report and/or title report. Following plat <br /> approval, it shall be recorded with the Marion County Clerk (final plat instructions and <br /> example enclosed). <br /> <br />3. Prior to plat approval, the applicants shall provide a drainage plan to Marion County <br /> Public Works, as described by Public Work's comments in Findings section #5. Prior to submission of the final plat, the applicant shall submit evidence of compliance <br /> with the development and access standards of the Sublimity Fire District. <br /> <br />5. The public right-of-way portion of Irish Glen shall be brought up to minimum mad <br /> standards, as required by Marion County Public Works. Drainage issues shall also be <br /> addressed in the widening of the road. The paxtition will create a private driveway that <br /> will serve four parcels.
