8. <br /> <br />9. <br /> <br />10. <br /> <br />Prior to issuance of building permits the applicant shall follow Public Works instruction <br />for removal of brush, trees, and sight obstructions, within the public right-of-way. <br /> <br />Prior to building permit the applicants shall obtain driveway permits for access from <br />Marion County Public Works. <br /> <br />The applicants shall obtain all necessary permits from Marion County Building Division. <br />These may include an Existing System Evaluation and a Site Evaluation. <br /> <br />Prior to issuance of a building permit, the applicant shall sign and record a Declaratory <br />Statement (statement enclosed) acknowledging the impacts of fanning activities in the <br />area. <br /> <br />11. <br /> <br />12. <br /> <br />Prior to issuance of a building permit, the applicant shall sign and record a Declaratory <br />Statement (statement enclosed) acknowledging the property is located in a Sensitive <br />Groundwater Overlay zone and the availability of groundwater may be limited. <br /> <br />Any structures or dwellings established on the newly created parcels shall be setback100 <br />feet from the northern property line. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions <br />must be continually satisfied: <br /> <br />13. <br /> <br />After the final partitioning, plat has been recorded no alteration of property lines shall be <br />permitted without first obtaining approval from the Planning Director. <br /> <br />OTHER PERMITS~ FEES~ AND RESTRICTIONS: This approval does not remove or affect <br />any covenants or restrictions imposed on the subject property by deed or other instrument. The <br />proposed use may require permits and/or fees from other local, State or Federal agencies. This <br />decision does not take the place of, or relieve the responsibility for obtaining other permits or <br />satisfying any restrictions or conditions thereon. It is recommended that the agencies mentioned <br />in Finding # 5, in the "Findings and Conclusion" section of the staff report, be contacted to <br />identify reslrictions or necessary permits. The applicants are advised of the following: <br /> <br />14. <br /> <br />Transportation and Park Development Charges shall be assessed upon development of the <br />home on the newly created parcel, at the time of building permits. For more information, <br />contact Byron Meadows at Public Works, (503) 588-5036. <br /> <br />15. <br /> <br />Any utility work in the public right-of-way Will require a permit from Marion County <br />Public Works. For more information, contact Byron Meadows at Public Works, (503) <br />588-5036. <br /> <br />16. <br /> <br />Construction of improvements on the property shall not block historical or naturally <br />occurring runoff from adjacent properties. Site grading shall not impact surrounding <br />properties in a negative manner. <br /> <br />APPEAL PROCEDURE: The Marion County Subdivision and Partition Ordinance provides <br />that certain Partition applications be considered first by the County Planning Director. If there is <br />any doubt that the application conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested person who disagrees with the <br />decision may request that the application be considered by the Marion County Hearings Officer <br />after a pubhc heating. The applicants may also request a reconsideration (one time only and a fee <br />of $200) on the basis of new information subject to signing an extension of the 120-day time <br />limit for review of zoning applications. <br /> <br /> <br />
