NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER <br />215 REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE <br />FORWARDED TO THE PURCHASER. <br />NOTICE OF DECISION <br />URBAN PARTITIONING CASE NO. 02-10 <br />APPLICATION: Application of J D Properties LLC to divide a 14,995 square foot parcel into <br />two parcels containing 8,845 square feet and 6,110 square feet each in a RS (RESIDENTIAL <br />SINGLE FAMILY) zone on property located at 4304 Leafwood Drive NE, Salem. (Section 18AB; <br />T7S; R2W). Lot 8300. <br />DECISION: Notice is hereby given that the Planning Director for Marion County has DENIED the <br />above described Partitioning application. <br />APPEAL PROCEDURE: The Marion County Subdivision and Partition Ordinance provides that <br />certain Partition applications be considered first by the County Planning Director. If there is any <br />doubt that the application conforms with adopted land use policies and regulations the Director must <br />condition or deny the application. Any interested person who disagrees with the decision may <br />request that the application be considered by the Marion County Hearings Officer after a public <br />hearing. The applicant may also request a reconsideration (one time only and a fee of $200) on the <br />basis of new information subject to signing an extension of the 120 day time limit for review of <br />zoning applications. <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County Planning Division, 555 Court St. <br />NE, 2"d Floor, Salem, by 4:30 p.m. on JUNE 21, 2002. Please note an appeal directly to the <br />Land Use Board of Appeals is not allowed under ORS 197.830. This decision is effective JUNE 22, 2002 unless further consideration is <br />requested. <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning Director <br />based the decision are noted below. <br />The property is in the Salem/Keizer Urban Growth Boundary (UGB) and is designated Single <br />Family Residential in the Salem Area Comprehensive Plan (SACP). The parcel is zoned RS <br />(SINGLE FAMILY RESIDENTIAL) under the jurisdiction of Marion County. <br />2. The property is located on the southeast corner of the intersection of Hollywood Drive and <br />Leafwood Avenue NE.
