<br />NOTICE OF DECISION <br />ADMINISTRATIVE REVIEW CASE NO. 00-19 <br />APPLICATION: <br /> Application of Voice Stream Wireless, on property <br />owned by Robert and Denise Totland, for an administrative review to <br />establish a wireless communication facility attached to an existing <br />190' cellular communications tower as a utility facility necessary <br />for public service on a 1.14 acre parcel in an EFU (EXCLUSIVE FARM <br />USE) zone located at 14448 Evans Valley Road, Silverton. (Section <br />35D; T6S; R1W). Lot 1500. <br />DECISION: <br /> Notice is hereby given that the Planning Director for <br />Marion County has determined that the proposed Wireless <br />Communication Facility is a utility facility necessary for public <br />GRANTS <br />service in the EFU zone and the application based on the <br />following findings. <br /> MAY <br />EXPIRATION: <br /> This decision is valid only when exercised by <br />23, 2002 <br />(two years from the effective date of the decision) <br />unless an extension is granted. The effective period of this <br />application may be extended for one year subject to approval of an <br />extension. Request for an extension must be submitted to the <br />Planning Division prior to expiration of the approval. (Extension <br />form available from the Planning Division). <br />CONDITIONS: <br /> <br />1.The applicants shall obtain all necessary permits from the <br />Marion County Building Inspection Division. <br />Other Permits, Fees and Restrictions: <br />The applicants are advised that the use of the property proposed in <br />this application may require additional permits and/or fees from <br />other local, State or Federal agencies. The Marion County land use <br />review and approval process does not take the place of, or relieve <br />the applicants of responsibility for acquiring such other permits, <br />or satisfying any restrictions or conditions thereon. <br />PROCEDURE: <br /> The Marion County Zoning Ordinance provides that <br />Administrative Review applications be considered first by the <br />County Planning Director. If there is any doubt that the applica- <br />tion conforms with adopted land use policies and regulations the <br />Director must deny the application. Any interested person who dis- <br />agrees with the Director's decision may appeal the decision to the <br />Marion County Hearings Officer. The applicant may also request a <br />reconsideration (one time only and a fee of $200.00) on the basis <br /> <br />
