<br />NOTICE OF DECISION <br />ADMINISTRATIVE REVIEW CASE NO. 00-14 <br />APPLICATION: <br />Application of Antoinette Bryant for an administrative <br />review to determine if two parcels containing 5.0 acres and 5.07 <br />acres each in an EFU (EXCLUSIVE FARM USE) zone have vested rights <br />for placement of a one non-farm dwelling on each parcel, located at <br />16157 and 16207 North Abiqua Road NE, Silverton. (Section 19; T6S; <br />R1E). Lots 800 and 900. <br />DECISION: <br /> Notice is hereby given that the Planning Director for <br />Marion County has determined that placement of dwellings based on <br />not <br />vested rights is possible through the administrative review <br />process. <br />PROCEDURE: <br /> The Marion County Zoning Ordinance provides that <br />Administrative Review applications be considered first by the <br />County Planning Director. If there is any doubt that the applica- <br />tion conforms with adopted land use policies and regulations the <br />Director must deny the application. Any interested person who dis- <br />agrees with the Director's decision may appeal the decision to the <br />Marion County Hearings Officer. The applicant may also request a <br />reconsideration (one time only and a fee of $200.00) on the basis <br />of new information subject to signing an extension of the 150 day <br />time limit for review of zoning applications. <br />A public hearing is held on appeals subject to the appellant paying <br />a $250.00 fee. Appeals must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 3150 Lancaster Dr. NE, Salem 97305 by 4:30 <br />MARCH 28, 2000 <br />. <br />p.m. on Please note an appeal directly to the <br />Land Use Board of Appeals is not allowed under ORS 197.830. If you <br />have any question about this application or the decision please <br />call 588-5038 or visit the County Planning Office at the above <br />MARCH 29, 2000 <br />address. This decision is effective unless <br />appealed. <br />FINDINGS AND CONCLUSIONS: <br /> The findings and conclusions on which <br />the Director based has decision are noted below. <br />1.The subject properties are designated Primary Agriculture in <br />the Marion County Comprehensive Plan and are zoned EFU <br />(EXCLUSIVE FARM USE). <br />2.The properties are located on the north side of Abiqua Road <br />NE, approximately 1,200 east of its intersection with Cascade <br />Highway NE. <br /> <br />
