3.Properties to the south, west, and north are zoned EFU and <br />consist of a mixture of small residential parcels and larger <br />parcels devoted to farm use. The septic systems <br />were completed and approved by the County on October 27, 1976. <br />The mobile home placement permits expired without being <br />executed. The applicants are now requesting an administrative <br />review to determine whether they have vested rights for <br />placement of a non-farm dwelling on each of two parcels. <br />7.Section 110.680 of the Marion County Rural Zoning Ordinance <br />(MCRZO) outlines the administrative review process. It states <br />in part: <br />“The Director or designee shall determine whether <br />dwellings, structures or uses which are subject to <br />standards or regulations are a permitted use or a <br />permitted use subject to the limited use provisions in <br />the applicable zone. The administrative review proce- <br />dures, as provided below, shall be followed in making <br />these determinations. The same process shall be used for <br />other administrative reviews under this Ordinance <br />including, but not limited to, modifications of the <br />special setbacks in Sections 128.040 (a), 136.050 (a), <br />137.050 (a), 138.050 (a), and 139.050 (a). <br />(a)The decision shall be made on the basis of the <br />Marion County Comprehensive Plan and applicable <br />standards and criteria in the Rural Zoning Ordi- <br />nance. The Director or designee may attach any <br />conditions of approval deemed necessary to ensure <br />conformance of the use or structure to the stan- <br />dards or criteria.” <br />8.As previously noted, the property is located in an EFU zone. <br />According to MCRZO 136.030 dwellings permitted subject to <br /> <br />
