standards must meet the requirements for a Primary Farm
Dwelling or a Secondary Farm Dwelling, there are no provisions
in the EFU zone for dwellings based on vested rights. In
addition, neither the Marion County Comprehensive Plan or
MCRZO contain standards or criteria applicable to this
request.
9.Marion County Building Inspection Division indicates that
their permits must remain active or they will expire after 180
days. Lack of any progress for 180 days, without an approved
request for an extension, voids that permit. Any subsequent
permits must meet the zoning regulations in effect at the time
they are applied for, in this case the current EFU zone. This
application does not include a request for a dwelling under
the current zone.
10.Based on the above discussion, Planning Division staff is
unable to determine, through the administrative review
process, that vested rights exist for placement of dwellings
on the subject properties.
Craig O.
