Plaintiffs must file and serve a response to this order and explain whether they intend to continue
with the case. The deadline for Plaintiffs to respond is August 31, 2020.
TCR-MD 21 provides: "The court may enforce any decision, order, judgment, or other
statement directing a party to perform a specific act by imposing sanctions on the party
refusing or neglecting to comply. Sanctions may include, but are not limited to, dismissal of
the case, placing the noncompliant party in default, and sanctions for contempt as authorized
by statute."
If Plaintiffs do not timely respond to this order, the court may treat such failure as an
abandonment of their case, and order sanctions against Plaintiffs, including but not limited to
dismissal of the appeal. Now, therefore,
IT IS ORDERED that Plaintiffs must file and serve a response to this order no later than
August 31, 2020. If Plaintiffs are unable to file a response due to the COVID-19 pandemic, they
may call the opposing parties and the court prior to August 31, 2020. If Plaintiffs fail to timely
comply with this order, the court may issue sanctions against Plaintiffs, including but not limited
to dismissal of the appeal.
Signed 8/17/2020 01'.56 PM
Richard Davis,Magistrate
This interim order may not be appealed. Any claim of error in regard to this
order should be raised in an appeal of the Magistrate's final written decision
when all issues have been resolved.
