Account Set-Up - Please indicate the cost of establishing accounts for each bonower within the <br />Funds described under Contract Formulation above. <br />ADDTTIONAL CONTRACTUAL INFORMATION <br />The selection of the firm to serve as Trustee is contingent upon the negotiation of a final award. <br />This RFP dces not commit the County to the award of a Contract, nor to pay any costs incurred <br />in the preparation and submission of proposals in anticipation of a Contract. The County <br />reserves the right to accept or reject, in whole or in part, any and all proposals received as a result <br />of this request, or to cancel all or any part of this RFP. In addition, the following clauses will be <br />in effect under Oregon State law. <br />Non-Availability of Funds <br />Every payment obligation of the Cownty under this RFP is conditioned upon the a~ailability of <br />funds appropriated or allocated for the payment of such obligation. If funds are not allocated and <br />available the contract may be terminated by the County at the end of the period for which funds <br />are available. No liability shall accrue to the County in the event this provision is exercised, and <br />the County shall not be obligated or liable for any future payments or for any damages as a result <br />of ternunadon under this paragraph. <br />The Contractor shall comply with Executive Order 75-5, which mandates that all persons, <br />regardless of race, color, religion, sex, age, national origin or political affiliatioq shall have <br />equal access to employment opportunities, and all other applicable State and Federal employment <br />laws, rules, and regulations, including the Americans with Disabilities Act. The Contractor shall <br />take affirmative action to ensure that applicants for employment and employees are not <br />discriminated against due to race, creed, color, religion, sex, national origin or disability. <br />Arbitration <br />The parties to the contract agree to resolve all disputes arising out of or relating to the contract <br />through arbitration, after exhausting applicable administrative review. <br />
